HomeMy WebLinkAbout89-0814 Kane County Forest Preserve 1 INTERGOVERNMENTAL AGREEMENT This agreement, made thisi4 day of 4-06ust" , 1989 between the City of Elgin, a municipal corporation, hereinafter referred to as "Elgin", and the Forest Preserve District of Kane County, a municipal corporation, hereinafter referred to as "Kane". Witnesseth: WHEREAS, Elgin and Kane deem it expedient and advisable to provide a for the use of their citizens beginning at Prairie Street along the east side of the Fox River to Kimball Street bridge; and WHEREAS, the 1970 Constitution of the State of Illinois, Art. VII, s10, provides for intergovernmental cooperation in and among units of local government to obtain or share services and to exercise in combine any power or function in any manner clot prohibited to them and to use their revenues to pay such costs related to such activi- ties; and WHEREAS, the Elgin is a home rule unit within the meaning of the Constitu- tion of 1970, with power to provide recreational facilities and the Forest Preserve District Act, Illinois Revised Statutes, 1987, Chapter 961/2 authorizes such activities by Kane; and WHEREAS, Illinois Revised Statutes, 1987, Chapter 127, s741-8 specifically authorizes such cooperation among units of local governments; and WHEREAS, in order to construct said project Elgin has been advised that it has been approved to receive funding from the Illinois Department of Conservation; and WHEREAS, it is necessary to designate a project sponsor to meet grant requirements, to construct the path and receive grant proceeds for disbursement. NOW, THEREFORE, it is agreed between the parties as follows: I. The parties agree to retain the firm of Hampton, Lenzini & Renwick, Inc. for the design and layout of the path as it relates to the Illinois Department of Conserva- tion Project 0S89-312, Urban Trail Link. 2. The Parties designate Elgin to administer the project for the purpose of preparing plans and specifications for contracts for construction of the path, advancing funds for payment of contractors and for compiling necessary documentation for processing of grant funds, and for such other requirements in connection with said path as may be necessary. 3. Elgin shall, when required, submit necessary documentation to the Department of Conservation to effect receipt of grant proceeds and to disburse them in accordance with this agreement. 4. All contracts shall be executed by Elgin and shall be in accord with applicable provisions relating to contracting by units of local government. 5. It is anticipated that the total budget for the project shall be approximately $379,000 and that grant proceeds from the Department of Conservation will be in the amount of $150,000. Kane and Elgin shall equally share in the remaining cost but Kane shall not be required to expend more than $100,000. 6. Kane shall pay Hampton, Lenzini & Renwick, Inc. for architectural fees and other related expenses. Such payments shall be deducted from the $100,000 matching funds agreed to by Kane. 7. Elgin shall own, maintain and control the path. IN WITNESS WHEREOF, the parties have signed this agreement on the day and year first above written. NOW, THEREFORE , BE IT RESOLVED by the Board of Commissioners of the Forest Preserve District of Kane County that the President and Secretary be authorized to execute the intergovernmental agreement referred to above and deliver certified copy thereof to the City of Elgin.
