FOR THE MICHIGAN STREET REDEVELOPMENT AREA - BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that James J. Cook, City Manager, be and is hereby authorized and directed to accept the proposal on behalf of the City of Elgin of Robert H. Anderson & Associates, Inc. for engineering services for the Michigan Street Redevelopment Area, a copy of which is attached hereto and made a part hereof by reference. George VanDeVoorde, Mayor Presented: May 25, 1989 Adopted: Vote: Yeas Nays Recorded: Attest: Marie Yearman, City Clerk (9) cozia gof July 5, 1989 Mayor and City Council City of Elgin 150 Dexter Court Elgin, Illinois 60120 Re: Michigan Street Redevelopment Area Dear Mayor and Aldermen: In accordance with instructions in a letter from Mary Buchheid, Planner,dated May 17, 1989, we will proceed with professional engineer services in connection with MICHIGAN STREET REDEVELOPMENT AREA (hereinafter called the "Project"),in conformance with the Michigan Street Redevelopment Area RFP,prepared by the Elgin Planning Department, and with our Letter of Proposal dated April 20, 1989. We would expect to start our services within ten (10) days after receipt of written authorization from you. You are expected to furnish us with full information as to your requirements including any special or extraordinary considerations for the Project or special services needed, and also to make available pertinent existing data. Our services will consist of preparing a Preliminary Design, as set forth in the printed General Provisions as amended and supplemented in Exhibit A thereto, both of which are attached to this letter, and such additional services as you may request. You will pay us for our services a lump sum fee of$17,345. We will bill you monthly for services. Payment is to be made within thirty (30) days of receipt of our invoice. These financial arrangements are based on the orderly and continuous progress of the Project. The schedule for the performance of our services are set forth in Exhibit A to the General Provisions. It is necessary that you advise us in writing at an early date if you have budgetary limitations for the overall Project Cost or Construction Cost. We will endeavor to work within those limitations. If you request we will submit to you periodically during the design phase of our services our opinions as to the probability of completing construction within your budget and where appropriate, request an adjustment in the budget or a revision in the extent or quality of the Project. We do not guarantee that our opinions will not differ materially from negotiated prices or bids. If you wish greater assurance as to probable construction costs or if you wish formal estimates, an independent cost estimator should be employed. Services are to be rendered in the customary phases which, together with the general understandings applicable to our relationship with you, are set forth in the General Provisions and Exhibit A thereto which are attached to and made a part of this proposal. DATE , 1989 FURTHER DESCRIPTION OF BASIC ENGINEERING SERVICES AND RELATED MA HERS: 1. This is an e..5hibit attached to, made part of and incorporated by reference into the Agreement made on Oa/t( 12-- , 1989 between CITY OF ELGIN, ILLINOIS, (Owner) and Robert H. Anderson &Associates, Inc., (Engineer) providing for professional engineering services for the MICHIGAN STREET REDEVELOPMENT AREA, on a nine (9) acre site, in Elgin,Illinois. The Basic Services of Engineer as described in Section 1 of the Agreement are amended or supplemented as indicated below and the time periods for the performance of certain services as indicated in Section 4 of the Agreement are stipulated as indicated below. 2. The Study and Report Phase has previously been completed by the City of Elgin and is not included in this agreement. 3. During the Preliminary Design Phase, ENGINEER shall: 3.1 Make a field survey of the site to obtain topographic and planimetric information on the site and prepare a topographic map of the site showing the location of existing utilities and infrastructure and contours at two (2) foot intervals. 3.2 Make a boundary survey and prepare a plat of survey and a legal description of the project area. 3.3 Based on the Conceptual Site Plan furnished by the OWNER, prepare a Preliminary Plan showing the proposed layout for parking lots, streets, sanitary sewers, water mains, storm sewers, typical cross sections and details and landscape improvements in conformance with City of Elgin ordinances, standards and specifications. 3.4 Prepare an opinion of probable project costs, based on the Preliminary Plan. Telephone and travel costs. 3.6 Procure and maintain professional liability insurance and shall furnish a "Certificate of Insurance" to the OWNER. The Preliminary Design Phase services will be completed and ENGINEER'S documentation and opinions of cost submitted within ninety (90) calendar days following written authorization from OWNER to Engineer to proceed with that phase of the services. 4. The Final Design Phase is not included. 5. The Construction Phase is not included. BACKGROUND: At its May 4 , 1989 meeting, the Greater Downtown Elgin Commission was given a presentation by staff from Planning and Public Works of the conceptual plan for the Michigan Street Redevelopment Project. As you might recall , the Council reached a consensus on this plan at a Committee of the Whole meeting on February 22 , 1989 and directed staff to obtain estimates of costs for the improvements . The Commission supported the need for redevelopment in that area and the need to pursue an engi- neering study. However, the Commission noted that the conceptu- al plan was larger in scope than was originally presented. In addition, the Commission expressed concern over the inclusion of homes along Villa Street for demolition. The Commission could not recommend support for the conceptual plan presented but proposed that the engineering study examine the areas which were addressed by earlier versions of the conceptual plan. BACKGROUND: The City Council considered various options for the development of the Michigan Street area at the Committee of the Whole meeting on February 22 , 1989. The Council then directed the staff to obtain estimates of cost for the improvements. The Planning Department sent a Request For Proposals (RFP' s) to five engineering firms and four responded. FINANCIAL IMPACT: The four engineering firms that responded with their respective fee for services are as follows: Walker Parking Consultants $24 ,500. 00 Midwest Consulting Engineers 21 ,435 . 00 Hampton, Lenzini & Renwick, Inc. 18, 000. 00 Robert H. Anderson & Assoc. , Inc. 17, 345 . 00 There is in the Community Development Block Grant Program $7 ,500 for this project , plus $200 ,000 budgeted in the 1989 Capital Improvement Program (385) . RECOMMENDATION: The Greater Downtown Elgin Commission (GDEC) on Thursday, May 4 , 1989 , discussed the project and the RFP' s which were presented by staff and the Commission noted that the plan presented was larger in scope than what they thought was neces- sary and expressed a concern about including the properties on Villa Street in the project. However, it is the recommendation of the GDEC that the City Council award the work for preliminary engineering services for the subject improvement to Robert H.
