RESOLUTION
AUTHORIZING EXECUTION OF A LEASE AGREEMENT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that James J. Cook, City Manager, and Marie Yearman, City Clerk, be and are hereby
respectively authorized and directed to execute a written lease agreement with
Gerald A. Benthusen for the property located adjacent to 255 Brookside Drive, Elgin,
Illinois, a copy of which is attached hereto and made a part hereof by reference.

LEASE AGREEMENT
This agreement made this 10th day of May, A.D. 1989, between the CITY OF
ELGIN, a municipal corporation, party of the first part, and GERALD A. BENTHUSEN,
party of the second part:
The party of the first part has leased to the party of the second part the
premises, situated in the City of Elgin, County of Kane and State of Illinois, known and
described as follows:
That part of the West Half of the Northwest Quarter of Section 16,
Township 41 North, Range 8 East of the Third Principal Meridian, described
as follows: Commencing at the Northwest Corner of Lot 45 of Country
Knolls Unit No. 18, being a subdivision of part of the Northwest Quarter of
said Section 16; thence Northerly, along the Northerly extension of the
West Line of said Lot 45, a distance of 25.00 feet for the point of
beginning; thence Southerly, along said line, a distance of 25.00 feet to the
said Northwest Corner of Lot 45; thence Easterly, along the North Line of
said Lot 45, a distance of 100.00 feet to the Northeast Corner of said
Lot 45; thence Northerly, along the Northerly extension of the East Line of
said Lot 45, a distance of 100.00 feet; thence Westerly, parallel with the
said North Line of Lot 45, a distance of 45.00 feet; thence Southwesterly, a
distance of 93.58 feet to the point of beginning. Being situated in the City
of Elgin, Kane County, Illinois and containing 0.18 acre more or less.
To hold these premises, unto the party of the second part, from the 10th day
of May, A.D. 1989, until the 10th day of May, A.D. 1990. And the party of the second
part in consideration of that lease agrees with the party of the first part as follows:
First. To pay to lessor at office of the city collector as rent for the leased
premises for the term the sum of Ten Dollars ($10.00).
Second. That he has examined and knows the condition of the premises; and
has received them in good order and repair, and that he will keep the premises in good
repair during the term of this lease, at his own expense; and upon the termination of this
lease will yield up the premises to the party of the first part in good condition and repair.
Third. That he will not sublet the premises, nor any part of them, nor assign
this lease without the written consent of the party of the first part.

Fourth. Lessee agrees to furnish lessor with insurance policies naming the
City of Elgin as coinsured, covering public liability in amounts of $I00,000/$300,000 and
property damage for $50,000.
All the parties to this lease agree that the covenants and agreements
contained here shall be binding upon their respective heirs, executors, administrators and
assigns.
WITNESS the hands and seals of the parties hereto, as of the Date of Lease
stated above.
