MEMORANDUM OF AGREEMENT
RANDALL ROAD — I-90 ILLINOIS TOLLWAY TO BIG TIMBER ROAD
CITY OF ELGIN AND COUNTY OF KANE
a This Memor ndum of Agreement made and entered into this
� day of _ , A. D. , 1988, by and between the
City of Elgin, a municipal corporation of the Counties of Kane and
Cook, State of Illinois , hereinafter referred to as "CITY" and the
County of Kane , State of Illinois , hereinafter referred to as
"COUNTY" .
WITNESSETH
WHEREAS , the CITY, in order to facilitate and assure the
proper flow of traffic on Randall Road between I-90 Illinois Tollway
and Big Timber Road at present and in the future , wishes to limit
direct street cut access from properties adjoining Randall Road ; and ,
WHEREAS , the COUNTY, in order to facilitate and assure the
proper flow of traffic on Randall Road between I-90 Illinois Tollway
and Big Timber Road at present and in the future , wishes to limit
direct street cut access from properties adjoining Randall Road ; and ,
WHEREAS , the CITY and the COUNTY have determined that
limitations on street cut access to Randall Road are necessary for
proper transportation and land use planning in the Randall Road
corridor between I-90 Illinois Tollway and Big Timber Road ; and ,
WHEREAS, the territory subject to this memorandum of
agreement is located within the CITY and the COUNTY.
NOW THEREFORE, in consideration of the mutual covenants
contained herein , the parties hereto agree as follows :
1 . The CITY agrees that, to the extent of its authority to do so , it
shall cause all forms of development approvals; including but not
limited to grants of special use , approval of zoning map
amendments, approval of plats of subdivision and approval of
annexation agreements ; for properties adjoining Randall Road
between I-90 Illinois Tollway and Big Timber Road to include
provisions for the elimination of direct street cut access to
Randall Road as an element of site design, except as provided for
herein and consistent with Exhibit A attached hereto.
2 . The COUNTY agrees that , to the extent of its authority to do so ,
it shall cause all forms of development approvals ; including but
not limited to grants of special use , approval of zoning map
amendments and approval of plats of subdivision ; for properties
adjoining Randall Road between I-90 Illinois Tollway and Big
Timber Road to include provisions for the elimination of direct
street cut access to Randall Road as an element of site
development , except as provided for herein and consistent with
Exhibit A attached hereto.
3. The COUNTY agrees to permit direct access to Randall Road between
I-90 Illinois Tollway and Big Timber Road at three (3) points
identified as Station A (Mason Road realigned) , Station B (Fox
Lane realigned) and Station C on attached Exhibit A.
4. The CITY agrees to vacate the portion of the right of way of
existing Fox Lane not included in the realignment , at the time of
the acceptance of improvements for Fox Lane realigned . Fox Lane
realigned shall be improved to "urban crossection" standards .
The CITY shall retain the existing fifteen ( 15) foot watermain
easement in the right of way of existing Fox Lane.
5.' The COUNTY agrees to vacate the portion of the right of way of
existing Mason Road not included in the realignment , at the time
of the acceptance of improvements for Mason Road realigned .
Mason Road shall be improved to "rural crossection" standards .
6 . The CITY and the COUNTY agree that each , to the extent of its
authority to do so, shall require alternative means of roadway
access for the properties adjoining Randall Road between I-90
Illinois Tollway and Big Timber Road in substantial conformance
to Exhibit A, and generally described as follows :
a. Parcel #1 shall have no direct street cut access to Randall
Road and shall be served by access at Station A, Mason Road
realigned . The existing driveway access to Randall Road
located approximately 2 , 020 feet north of the centerline of
the intersection of Randall Road and existing Fox Lane shall
be eliminated .
b . Parcel #2 shall have direct street cut access to Randall Road
at Station B, Fox Lane realigned . The access located at
existing Fox Lane shall be eliminated .
c . Parcel #3 shall have direct street cut access to Randall Road
at Station A, Mason Road realigned and at Station B, Fox Lane
realigned . The access located at existing Fox Lane shall be
eliminated .
d . Parcel #4 shall have no direct street cut access to Randall
Road and shall be served by Proposed Road RE. The driveway
accesses to Randall Road located at approximately 710 feet
and 840 feet north of the centerline of the intersection of
Randall Road and Fox Lane shall be eliminated .
e. Parcel #5 shall have no direct street cut access to Randall
Road and shall be served by Proposed Road RW. The access
located at existing Fox Lane shall be eliminated . The
existing driveway access to Randall Road shall be eliminated .
f. Parcel #6 shall have direct street cut access to Randall Road
at Station C. The access located at existing Fox Lane shall
be eliminated . The existing driveway access to Randall , Road
located approximately 1 , 410 feet north of the centerline of
the intersection of Randall Road and Big Timber Road shall be
eliminated .
g. Parcel #7 shall have no direct street cut access to Randall
Road and shall be served by Proposed Road RW. The existing
driveway access to Randall Road shall be eliminated .
h. Parcel #8 shall have no direct street cut access to Randall
Road and shall be served by Big Timber Road .
i . Parcel #9 shall have no direct street cut access to Randall
Road and shall be served by Proposed Road RW. The existing
driveway access to Randall Road shall be eliminated .
j . Parcel #11 shall have no direct street cut access to Randall
Road and shall be served by Proposed Road RW. The existing
driveway access to Randall Road shall be eliminated .
k. Parcel #13 shall have no direct street cut access to Randall
Road and shall be served by Station C. The existing driveway
access to Randall Road shall be eliminated .
1 . Parcel #15 shall have direct street cut access to Randall
Road at Station C.
m. Parcel #17 shall have no direct street cut access to Randall
Road and shall be served by Big Timber Road .
n . Any other unspecified parcels existing or platted in the
future, shall have no direct street cut access to Randall
Road .
7. This agreement shall be binding upon and inure to the benefit of
the parties hereto , their successors , and assigns for a term of
twenty (20) years .

MEMORANDUM
TO: Mayor and Members of the City Council
FROM: City Manager
SUBJECT: Intergovernmental Agreement
Purpose :
To present a proposed intergovernmental agreement between the City of
Elgin and Kane County regarding access to Randall Road .
Background :
The Planning Committee and the staff are in the process of developing
an amendment to the Comprehensive Plan for the Northwest Subarea for
the City Council ' s consideration. Recently , the City Council
approved a preliminary plan submitted by CMD Elgin Associates for the
development of the former Teeple property . An issue of great
importance to the Northwest Subarea planning effort and the CMD
development proposal is the resolution of the location of future
access points on Randall Road .
The city has cooperated with Kane County in efforts to retain a
limited access design for Randall Road . In order to continue and
reinforce city/county transportation planning , the staff has drafted
a proposed intergovernmental agreement regarding access to Randall
Road in the corridor between I-90 and Big Timber Road . A draft of
the proposed agreement is attached .
Basically , the agreement calls for direct access to Randall Road to
be limited to three (3) points ; Mason Road realigned , Fox Lane
realigned and Holmes Road extended . The city and the county would be
committed to exerting their best efforts to obtain the closing of all
other points of direct access to Randall Road in the I-90/Big Timber
corridor . The elimination of existing direct access to Randall Road
would occur as alternative means of access became available for the
various affected properties . Northwest Subarea planning anticipates
alternate roadways paralleling Randall Road .

Financial Impact :
There is no financial impact associated with this action.
Recommendation :
The Planning Committee reviewed a draft of the proposed
intergovernmental agreement during their regular meeting on March 16 ,
1988. On a motion to recommend the adoption of the agreement the
vote six (6) yes and zero (0) no .

SUBJECT: Intergovernmental Agreement-Randall Road
As you are aware, the city has been in the process of developing
an amendment to the Elgin Comprehensive Plan for the Northwest
Subarea. This has been undertaken concurrent with the review of
the proposed annexation , zoning and subdivision of the 170 acre
former Teeple Farm by CMD Midwest . An issue of critical
importance to the Northwest Subarea planning effort and the review
of the CMD development proposal is the resolution of the location
of future access points on Randall Road .
The city has cooperated with Kane County in efforts to retain a
limited access design for Randall Road . In order to continue and
reinforce city/county transportation planning, the Planning
Department has negotiated the basic elements of an
intergovernmental agreement regarding access to Randall Road in
the corridor between I-90 Illinois Tollway and Big Timber Road . A
draft of this agreement is attached for your review and comment .

the acceptance of improvements for Fox Lane realigned.
5. The COUNTY agrees to vacate the portion of the right of way of
existing Mason Road not included in the realignment , at the time
of the acceptance of improvements for Mason Road realigned.
6. The CITY and the COUNTY agree that each , to theextent of its
authority to do so, shall require alternative means of roadway
access for the properties adjoining Randall Road between I -90
Illinois Tollway and Big Timber Road in substantial conformance
to Exhibit A, and generally described as follows:
a. Parcel #1 shall have no direct street cut access to Randall
Road and shall be served by Mason Road realigned .
