Yeas: Councilmen Fox, Gilliam, Moylan, Popple, Shales , Walters and Mayor Van De Voorde. Nays: None. April 27 , 1988 MEMORANDUM TO: Mayor and Members of the City Council FROM: City Manager SUBJECT: Jaynes Industrial Park Abrogation of Easement PURPOSE: This memorandum will provide the Mayor and Council with information to consider the abrogation of an easement in the Jaynes Industrial Park. BACKGROUND: The NTN Corporation has been in business for many years at the northeast corner of Holmes Road and McLean Boule- vard. They are again in the process of expanding their opera- tions at that site to fill the existing property. In addition to this expansion to their existing facilities, they are at- tempting to acquire two lots in the Jaynes Industrial Park. An existing easement between Lots 1 & 2 of Jaynes Industrial Park would not allow the construction of the building NTN would like to see on the lots. All of the utilities concerned, Illinois Bell Telephone, Northern Illinois Gas, Commonwealth Edison and Centel Cable Television, have executed abrogations of this easement. The Engineering Division has reviewed the easement in question and found that the easement contains no utilities controlled by the City. There appears to be no reason to hold any further interest in this easement. The property can be served by the easement on the east side of lot 2 . This abrogation of easement was presented to staff on Wednesday morning, April 20 , 1988 . No urgency was placed on this matter at that time. Bob Ahnen, a representative of the owners of Jaynes Industrial Park, called staff on Tuesday, April 26 , 1988 , stating that the sale of this property was to close on either Thursday or Friday of this week. He, therefore, urgently requested that the Council consider this abrogation immediately. FINANCIAL IMPACT: N/A. RECOMMENDATION: It is recommended that the City Council author- ize the abrogation of the public utility easement between lots 1 & 2 of Jaynes Industrial Park.
