WHEREAS, the community Crisis Center, Inc., an Illinois not-for-profit
corporation, is the owner of certain real property, legally described below, and commonly
known as the Franklin School; and
WHEREAS, the Community Crisis Center, Inc. desires to rehabilitate said
property for use as a community crisis center; and
WHEREAS, the Community Crisis Center, Inc. has requested that the City of
Elgin, a municipal corporation and a home rule unit within the meaning of the Constitu-
tion of 1970, provide community block grant funds for the purpose of aiding in the cost of
rehabilitation necessary for the conversion of the subject property to a community crisis
center; and
WHEREAS, the City of Elgin is willing to provide said assistance upon certain
terms and conditions.
NOW, THEREFORE, in consideration of the premises and the mutual agree-
ments of the parties hereto, one to the other, it is hereby agreed between the City of
Elgin, a municipal corporation, and the Community Crisis Center, Inc., an Illinois not-
for-profit corporation, as follows:
I. That the City of Elgin shall provide the sum of $179,040 from available
Community Development Block Grant Rehabilitation Funds as part of the cost of
rehabilitating the structure located upon the following legally described premises for use
as a community crisis center:
The South 66 feet of Lots 4 and 5 and all of Lots 6 and 7, of Block 2
of J. T. Gifford's Original Plat of Elgin, in the City of Elgin, Kane County,
Illinois.
2. That the City shall advertise for bids for the necessary rehabilitation
work and shall let the contract to the lowest responsible bidder.
3. That the Community Crisis Center, Inc. shall provide the sum of
$163,635 as its contribution toward the cost of rehabilitation and shall be responsible for
any further amounts due and owing the contractor for rehabilitation work done.
4. That in the event that the subject premises are sold within ten years of
the date of this agreement, the Community Crisis Center, Inc. shall reimburse the City
of Elgin in the amount of $179,040.
5. That the Community Crisis Center, Inc. further agrees that for a period
of ten years following the execution of this agreement, the subject property shall be used
primarily for a community crisis center unless the City of Elgin shall agree to a change
in use.
6. That this contract shall be recorded in the Office of the Recorder of
Deeds of Kane County, Illinois and shall constitute and represent a covenant running with
the land.
