PROVIDING FOR ADDING BIG TIMBER ROAD AS A COUNTY HIGHWAY EXTENSION FROM ILLINOIS ROUTE 31 TO CONGDON AVENUE WHEREAS, it has been determined that it is in the interest of Kane County, State of Illinois to make a change in the County Highway Extension in said County; and . , WHEREAS, the authority to make such change is provided by Section 5-106 of the Illinois Highway Code, subject to the approval of the Illinois Depart- ment of Transportation, NOW, THEREFORE, BE IT RESOLVED, by the County Board of Kane County, State of Illinois, that the following described location be added as County Highway No. 21 Extension: Beginning at the intersection of County Highway No. 21 (Big Timber Road) with Illinois Route 31 (State Street) extending generally in an easterly direction crossing the Fox River in the block lying between Belle Avenue and Jerusha Road and continuing generally in an easterly direction to the intersection of Congdon Avenue at Prospect Avenue and then continuing easterly along Congdon Avenue to Dundee Road State Route 25 in the City of Elgin. BE IT FURTHER RESOLVED, that the County Clerk is hereby directed to transmit two (2) certified copies of this resolution to the Department of Transportation of the State of Illinois through its District Engineer, 1000 Plaza Drive, Schaum- burg, Illinois, 60196. STATE OF ILLINOIS COUNTY OF KANE RESOLUTION NO. 8.61~~ i4 AUTHORIZING AMENDED MEMORANDUM OF AGREEMENT WITH CITY OF ELGIN FOR CONSTRUCTION OF BIG TIMBER ROAD-FOX RIVER BRIDGE WHEREAS, the City of Elgin has heretofore requested the County of Kane to enter into a joint agreement for the construction of Big Timber Road from Illinois Route 31 easterly across the Fox River to Congdon Avenue at Prospect BouleVard', and WHEREAS, such improvements will facilitate the east-west traffic flow, including an additional crossing of the Fox River, for the City of Elgin and will be of immediate benefit to the residents of the County of Kane and permanent in nature. NOW, THEREFORE, BE IT RESOLVED by the County Board of the County of Kane that the Chairman of the County Board be, and is hereby authorized and directed to execute on behalf of the County of Kane the Memorandum of Agreement between the City of Elgin and the County of Kane for the project herein stated. PASSED by the Kane County Board On %u.,,AA,,,u,..1%.,\ kli 3 M(Y ' ATTEST: Crk, County Board -- Chairman, County Bbard , ~ - AMENDED MEMORANDUM OF AGREEMENT BIG TIMBER ROAD - FOX RIVER BRIDGE BETWEEN CITY OF ELGIN AND COUNTY OF KANE This Amended Memorandum of Agreement made and entered into this --_ day of 100° A.D. , l9;. , by and between the City of Elgin, Kane County, Illinois, hereinafter referred to as the "CITY" and Kane County, Illinois herein- after referred to as the "COUNTY". WITNESSETH WHEREAS, the CITY, in order to facilitate the east-west traffic flow including an additional crossing of the Fox River by extending Big Timber Road (County Highway 21 ) from the intersection with Illinois Route 31 easterly across the Fox River to Congdon Avenue at Prospect Boulevard and thence easterly to Dundee Avenue following the alignment prepared by H.W. Lochner, Inc. , dated March 14, 1985; and WHEREAS, the CITY and COUNTY are desirous of causing said improvements to be made in that same will be of immediate benefit to the residents of the CITY and COUNTY and permanent in nature. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows; (1 ) The CITY agrees to cause the plans , specifications and estimates for such construction to be prepared and shall submit same to the COUNTY and to the Depart- ment of Transportation, Division of Highways, State of Illinois, for review and approval . (2) The CITY agrees to solicit and receive bids for construction of the improvements following approval of the plans and specifications by the COUNTY and the Department of Transportation and upon approval by the COUNTY and the STATE, award the contract, furnish engineering inspection during construction, and cause the improvement to be built in accordance with the plans , specifications, and con- tract. (3) The CITY and COUNTY agree to pass resolutions appropriating sufficient funds from Motor Fuel Tax Funds or other local funds to pay their apportionate share of the cost of this improvement and to provide certified copies thereof to each other. The COUNTY shall monthly issue warrants payable to the CITY, for amounts equal to the payments requested on monthly payment estimates, supported by necessary documentation, as submitted by the CITY to cover the COUNTY'S share of the cost for construction and engineering services. Upon completion of the construction and approval by the COUNTY and STATE, the COUNTY shall issue warrants payable to the CITY for the balance of its share of the total project. (4) It is mutually agreed that the cost of the improvement shall be borne equally between the CITY and the COUNTY on a fifty-fifty /50-50\ basis for the ^ construction and engineering costs, and costs incidental thereto, but that the ^ " maximum amount to be borne by the COUNTY under this agreement shall not exceed three (3.0) million dollars, including any prior payments made by the COUNTY for this project in the approximate amount of ninety-four thousand dollars ($94,000'00) ' (5) The CITY agrees that all maintenance and any further improvements to this segment of highway shall be the responsibility of the CITY, unless the parties otherwise agree in writing. (6) The CITY further agrees that as of the date of contract award for the construction of the said Fox River Bridge, it will assume all maintenance respon- sibility for Big Timber Road from Randall Road easterly to State Street (Illinois Route 31 ) and thereby remove such responsibility from the COUNTY. (7) The COUNTY agrees that should future construction, reconstruction or widening of Big Timber Road from Randall Road to State Street (Illinois Route 31 ) become necessary, the COUNTY shall assume fifty percent /50%\ of the costs therefore as a joint project with the CITY pursuant to the CITY-COUNTY Agreement dated March 29, 1983. (8) This amended agreement and the covenants contained herein shall be null and void in the event the contract covering the construction work contemplated herein is not awarded by January 1 , 1988, except that this agreement shall be in full force and effect with respect to any costs incurred in designing the improve- ment described. (9) This amended agreement shall be binding upon and inure to the benefits Of the parties hereto, their successor, and assigns . PASSED by the Kane County Board 0O \ 4 , 1986.
