INTERGOVERNMENTAL AGREEMENT FOR THE PROVISION OF ENVIRONMENTAL HEALTH SERVICES
This agreement entered into as of the -CZ , M , by and between
dP - :ne County, Illinois as a municipal corporation (here and
after referred to as the City) , and the County of Kane, Illinois a body politic and
corporate (here and after called the County) .
WITNESSETH:
WHEREAS the County wishes to enter into an agreement with the City to provide environ-
mental services relating to food service sanitation, retail food store sanitation,
nuisance and solid waste .program activities: and
WHEREAS the Parties hereto seek to protect the health of the citizens of the County
and the City by undertaking this agreement contained herein through their joint effort;
and
WHEREAS, the 1970 Illinois Constitution (Article VII, Section X) and the Illinois
Revised Statutes, 1983, Chapter 127, Section 741-748, provide authority for inter-
governmental cooperation.
NOW THEREFORE, in consideration of the premises, and such other considerations as here
and after set forth, the Parties hereto agree as follows:
1. The City, through it's Bureau of Inspection Services, shall conduct food service
sanitation, nuisance, and solid waste programs, according to the "Standards for
Local Health Departments" promulgated by the Illinois Department of Public Health
dated July 1, 1981.
2. The City agrees to employ staff who meet the requirements of the "Minimum Qualifi-
cations for Local Health Department Personnel in Illinois" promulgated by the
Illinois Department of Public Health.
3. The City agrees to adopt and enforce ordinances and rules and regulations which
are equivalent as a minimum to the State of Illinois Food Service Sanitation and
Retail Food Store Rules and Regulations.
4. The City shall retain the authority to set permit fees and collect all permit fees
associated with the operation of these programs.
5. The County agrees to provide assistance to the City when requested, regarding any
foodborne illness investigation, food recall notices, and/or other specific program
activities, pursuant to guidelines established by the City and County.
6. The County further agrees to provide qualified personnel to assist the City in the
private sewage disposal and individual water supply programs.
7. The County agrees to hold harmless and to indemnify the City, it's board members,
officers, agents and employees from liability, costs, judgements, attorney's fees,
or other expenses resulting from any act by the County or failure to act under
this Agreement. Likewise, the City agrees to hold harmless and to indemnify the
County, it's board members, officers, agents and employees from liability, costs,
judgements, attorney's fees, or other expenses from any act by the City or
failure to act under this Agreement.
8. Each Party further agrees to share information, records, and other documents which
may be necessary to fulfill the requirements of this agreement to the extent
permitted by law.
9. Each Party further agrees there will be no financial or funding obligation expected
of either Party.
10. The Parties hereto shall at any time during the term of this agreement have the
right to terminate same agreement upon thirty (30) days written notice to the
other Party. Said notice shall be sent certified mail, return receipt requested.
11. This intergovernmental agreement may be amended only by resolution of the corporate
authority of each Party hereto.
12. If any provision of this agreement is invalid for any reason, such invalid portion
shall not render the remaining provisions of this agreement which can be given
affect without the invalid provision to carry out the intent of the Parties as
stated herein.
In Witness Whereof, the undersigned Governmental Units have caused this agreement to
be duly executed.

SUBJECT: Proposed Intergovernmental Agreement with Kane
County for Environmental Health Services
Pursuant to your request, I have reviewed the attached proposed
Intergovernmental Agreement with Kane County.
Section 7 of the agreement provides for indemnification by each
party. You will notice I have added language to this section which I
believe clarifies the section.
The remainder of the draft agreement appears acceptable. Please
advise if you have any additional questions.

MEMORANDUM

SUBJECT: Proposed Intergovernmental Agreement Between the
City of Elgin and Kane County for Environmental
Health Services
PURPOSE
This memo will transmit the revised intergovernmental agreement
with Kane County for provision of health services in Elgin.
BACKGROUND
At the request of the City Council , Kane County has provided
documentation regarding their funding policy for environmental
health programs. A fee for service concept will cover the cost
of all environmental health services, with no local tax money
expended for these services. The County will not assess fees
within the City of Elgin. Elgin will continue to collect
restaurant and food store license fees.
The draft agreement has been reviewed by the Legal Department
and approved with a clarification to Section 7.
RECOMMENDATION
The staff recommends the signing of the intergovernmental agree-
ment.
