HomeMy WebLinkAbout86-0201 National Center '6(0-- oaor AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN THE CITY OF ELGIN, ILLINOIS AND THE NATIONAL CENTER FOR MUNICIPAL DEVELOPMENT, INCORPORATED THIS AGREEMENT is made and entered into as of the first day of February, 1986, by and between the City of Elgin (hereinafter referred to as the "City") and the National Center for Municipal Development, Inc. (hereinafter sometimes referred to as the "Consultant") . WITNESSETH WHEREAS, the City desires to engage a Consultant to represent Elgin in Washington, D.C. ; and WHEREAS, Consultant, the National Center for Municipal Development, Inc. (which maintains offices at 1620 Eye Street, N.W. , Washington, D.C. and has a "taxpayer" identification of 23-7420658) , has proven record of ability to perform such consultation; The CITY OF ELGIN and the National Center for Municipal Development, Inc. for the considerations and under the conditions set forth herein do agree as follows: I. The Consultant agrees: A. The National Center for Municipal Development, Inc. will act as legislative and administrative consultant for the City in Washington, D.C. and will assign a senior professional member of its staff to act as Washington Assistant to the City of Elgin; B. The National Center for Municipal Development, Inc. will provide supervision of the Washington Assistant as desired by the City and proportionate to the level of service specified in Subparagraphs D through L below; C. The National Center for Municipal Development, Inc. , will furnish requisite office space, utilities, furnishings and equipment, secretarial services, common-use office supplies and services, general administrative support, and consultation with the urban research staff and access to those ongoing research activities and studies of the National League of Cities and the U.S. Conference of Mayors required by the Washington Assistant to the City of Elgin in the performance of his/her prescribed functions under this Agreement; -2- D. The Washington Assistant will confer with the City Manager and such other City personnel as the City Manager may designate at the times and places mutually agreed to by the City Manager and the Washington Assistant on all organizational planning and program activities which have a bearing on the ability of the City to make the best use of federal aid programs; E. The Washington Assistant will review federal executive proposals, legislation under consideration, proposed and adopted administrative rules and regulations and other Washington developments for the purpose of advising the City on his/her own initiative of those items which may have a bearing on City policy or programs; F. More specifically, the Washington Assistant will advise and consult on behalf of the City with the White House and the following federal agencies or departments: Commerce, SBA, Treasury, HUD, Labor, HHS, OMB, DOT, EPA, Interior, Justice, DOE, and such other agencies, departments and commissions as may be necessary to the performance of full Washington service to the City Manager and the City. Additionally, the Washington Representative will act as liaison with the U.S. Conference of Mayors and the National League of Cities, and will furnish legislative and administrative analyses of issues involving any and all of the above enumerated agencies and departments; G. The Washington Assistant will secure and furnish such detailed information as may be available on federal programs in which the City indicates an interest; H. The Washington Assistant will review and comment on proposals of the City which are being prepared for submission to federal agencies when requested to do so by the City Manager or his designees; I. The Washington Assistant will maintain liaison with the City's Congressional delegation and will assist the delegation in any matter which the City determines to be in its best interest in the same manner as any other member of the City's administrative staff might render assistance; J. The Washington Assistant will counsel with the City regarding appearances by City personnel before Congressional committees and administrative agencies and will arrange for appointments and accommodations for City personnel as necessary; K. The Washington Assistant will contact federal agencies on the City's behalf when City applications are under consideration by such agencies and otherwise take whatever steps appear to him/her to be required to obtain the most favorable consideration of such applications; -3- L. The Washington Assistant will advise and consult with or otherwise make assistance available to such representatives of the private sector who are engaged in economic development activities as determined by the City Manager to be in the best interests of the City of Elgin; and M. In fulfilling his/her responsibilities under this Agreement, the Washington Assistant will act in the name of the City of Elgin and with the title of Washington Assistant to the City Manager under the supervision of the City Manager. Any change in the person of the Washington Assistant from the person representing the City as of the effective date of this Agreement must be approved by the City Manager. II. The City of Elgin agrees to: A. Advise the National Center for Municipal Development, Inc. , of the name or names of persons other than the City Manager authorized to request service by the Washington Assistant and the person or persons to be kept advised by the Assistant; B. Supply the National Center for Municipal Development, Inc. , with a summary of all federal programs in which the City is participating and advise the National Center for Municipal Development, Inc. , of any new applications filed, together with pertinent details as to the substance of such applications; C. Supply the National Center for Municipal Development, Inc. , with copies of budgets, planning documents, and regular reports of the City Manager and departments, Council agenda and proceedings, newspapers and other materials which will assist the Representative in keeping current on City policies and programs; D. Reimburse the National Center for Municipal Development, Inc. for: (1) all travel expenses incurred pursuant to paragraph 1, subparagraph D; (2) all travel expenses for attendance at any other meetings attended by the Washington Assistant outside Washington, D.C. at the request of the City; and E. Reimburse the National Center for Municipal Development, Inc. for other expenses which are incurred within Washington, D.C. on behalf of the City in carrying out the provisions of this Agreement and as approved by the City Manager subject to the provisions of paragraph 4; and -4- F. All long distance telephone expense and extraordinary postage will be borne by the City. The City Manager will determine policy regarding telephone usage. III. The City of Elgin and the National Center for Municipal Development, Inc. , concur that the following exclusions shall apply to this agreement: A. The City Representative: 1. will not represent commercial or industrial establishments of the City in pursuit of federal business except in accordance with the provisions of Paragraph I, Subparagraph L, above. 2. will not, by virtue of this Agreement, represent other local government agencies in Elgin except those which are instrumentalities or agencies of the City of Elgin; 3. will not perform any legal, engineering, accounting or other similar professional service; B. The National Center for Municipal Development will not: 1. represent a position which clearly and directly conflicts with the National League of Cities and the U.S. Conference of Mayors; 2. directly or indirectly participate in or intervene in any political campaign on behalf of or in opposition to any candidate for public office. IV. Washington, D.C. 20006 23-7420658 TAXPAYER IDENTIFICATION NUMBER January 7, 1986 MEMORANDUM TO: Mayor and Members of the City Council FROM: City Manager SUBJECT: National Center for Municipal Development (NCMD) Contract PURPOSE: The purpose of this memorandum is to consider the attached agreement with the NCMD for certain consulting services. BACKGROUND: On January 14 , 1985, the City Council approved a resolution accepting a proposal from the NCMD for consulting services. During the year, the NCMD provided the City with information on federal aid programs, legislation under consideration, executive branch proposals and copies of adopted administrative rules and regulations. In addition, the NCMD was instrumental in achieving beneficial modifications to the Fair Labor Standards Act by consulting with Congressional leaders. The renewal agreement with NCMD is the same as the one approved last year with no change in the scope of services or fees. FINANCIAL IMPACT: The cost of the services contained in this agreement is $25,000 plus a maximum of $1 , 500 in reimbursable expenses. In 1985, the reimbursable expenses amounted to a little over $1,400. There is $26,000 in the 1986 budget ( 190-809 ) for the NCMD contract.
