INTERGOVERNMENTAL AGREEMENT
For and in consideration of the mutual covenants and conditions contained
herein, the Forest Preserve District of Kane County (District) and the City of Elgin
(Elgin) agree as follows:
I. Elgin shall negotiate and acquire the real property commonly known as
414 McBride Street, Elgin, Illinois, and legally described as follows:
Lots 3, 4 and 5 of Thomas McBride's Subdivision of Out Lot 2 of
Phineas J. Kimball Jr.'s Third Addition to Elgin (excepting from said Lot 5
the part thereof described as follows: Commencing at a point in the North
line of said Lot 5, 8 rods West of the westerly line of McBride Street;
thence southerly parallel with the westerly line of McBride Street 4 rods;
thence easterly parallel with the northerly line of said Lot 5, 8 rods to the
westerly line of McBride Street; thence northerly along the westerly line of
McBride Street 4 rods to the northerly line of said Lot 5; thence westerly
along said northerly line of said Lot 5, 8 rods to the place of beginning), all
in the City of Elgin, Kane County, Illinois. (hereafter Premises)
Provided, however, in the event Elgin is unable to negotiate the purchase of the Premises
for not more than $86,000, this agreement shall be void and of no effect.
2. The District shall provide the sum of $30,000 to be used to acquire the
Premises. In addition, the District shall loan to Elgin at 0% interest, the sum of $30,000
to be used to acquire the Premises. Elgin shall repay said loan on or before March I,
1986. District shall tender the foregoing amounts (total $60,000) upon written request of
Elgin within 30 days of closing.
3. Elgin shall take title to the Premises in its name. As soon as possible
after acquisition, but in any event prior to January I, 1986, Elgin shall convey by quit
claim deed the river front portion of the Premises and the river front portion of the
property located immediately south of the Premises which is currently owned by Elgin
and used as part of its Public Works Maintenance Facility (hereafter river frontage).
This river frontage shall contain approximately 1.66 acres and consist of a strip of land
approximately 140 feet wide immediately east of the Fox River shoreline.

4. Elgin shall permit access across the Premises to the river frontage by the
District and general public. In addition, in the event Elgin constructs a parking facility
on the Premises, Elgin shall make said facility available to the general public.
WHEREFORE, the parties have signed and affixed their seals hereto this: /A-k

ADDENDUM
Parties agree that Elgin shall be responsible for the maintenance
of the river front portion of the premises referred to herein and the
river front portion located immediately south of the premises which
will be deeded to the Forest Preserve District.
Maintenance shall be construed to include lawn mowing and the
removal of trash and rubbish which may accumulate on the site.
