W I T N E S SET H: For and in consideration of the sum of One Dollar ($1.00) and other good and valuable consideration, Grantor and Grantee agree as follows: - 1. Grantor gives and grants to Grantee the right to construct, rehabilitate, and maintain a sewer line under and through Grantor's property located in Lot 12, Block 34 of the original Town of Elgin, on the west side of the Fox River, (307 W. Highland, Elgin, Illinois) along the same route as the existing sewer line as shown on the scale line drawing marked Exhibit "A", attached hereto, and incorporated herein. 2. In consideration of said right, Grantee agrees to perform the aforementioned work and to lay and rehabilitate the sewer line at sufficient depth to not interfere with Grantor's use and enjoyment of the property; to hold Grantor harmless from any cost, damage, or liability to person or property arising out of the laying, rehabilitating, maintaining, operating and repairing of the sewer line; and to remove the existing pump islands and to restore the surface of Grantor's property to an even grade, level with and in the same construction as the existing surface. Malm, Acting City Manager FROM: Ralph L. Ridley, Civil Engineer ILV. RE: Chicago Street Combination Sewer Rehabilitation Sewer Construction Easement During the preconstruction conference a few weeks ago for the above referenced project the contractor, Pipe-Liner Limited, indicated that they would require an easement at the abandoned Clark Station, 307 West Highland Avenue. Mr. Pat Fleming, Donohue and Associates, and our office then contacted Clark Oil and Refining Corporation, St. Louis, Missouri . Mr. Joel F. Graziani , Attorney for Clark Oil and Refining Corporation, prepared an easement (copy attached) for the construction of the above referenced Combination Sewer Rehabilitation, as a result of our contact. We are sending the two (2) original easements to Marie Yearman. The contractor has agreed to remove the three (3) pump islands mentioned in the easement and to pave the area disturbed by this construction with two and one half (22) inches of asphalt as part of his contract. This easement is permanent and gives the City of Elgin the right to not only do this work but also re-enter the property for repairs at anytime in the future. The Legal Department has reviewed and approved the easement document. We would, therefore, recommend that the City Council accept this easement, execute it and have the City Clerk file it with the Kane County Clerk.
