ACCEPTING A GRANT OF PERMANENT EASEMENT

BE IT RESOLVED BY THE CITY COUNCIL OF I CITY OF ELGIN, ILLINOIS, .p
that it hereby accepts a grant of permanent easement from Chicago Title --
and Trust Company, as Trustee under Trust No. 1081747 for the construc-
tion and maintenance of roadway improvements, a copy of which is attached c Cr)

GRANT OF PERMANENT EASEMENT
This Indenture, made and entered into this 27thday of Febnuray ,
1984, by and between CHICAGO TITLE AND TRUST COMPANY, AS TRUSTEE
UNDER TRUST NO. 1081747
herinafter referred to as Grantor and the City of Elgin, a municipal corporation
of the State of Illinois, hereinafter referred to as City.
Withnesseth:
That in and for the consideration of one dollar ($1 .00) and other good
and valuable consideration, receipt of which is hereby acknowledged, Grantor
does hereby grant and convey to the City an easement for the construction and
maintenance of roadway improvements in, upon and over the property described
and shown on the "Plat of Permanent Right-of-Way Easement" attached hereto and
made a part hereof.
This grant of easement is executed and granted upon the following
conditions:
1 . Grantor agrees that no building shall be constructed over said
easement.
2. City shall at all times prosecute all work upon the premises
with reasonable, care, skill and diligence and upon completion thereof will
promptly restore all grounds and ground coverings to their original condition.
This easement shall be binding upon the Grantor's successors, heirs and
