ACCEPTING A GRANT OF TEMPORARY EASEMENT
WHEREAS, it is necessary and desirable to obtain a temporary access
easement across certain property located to the east side of the Willard
Detention Area; and
WHEREAS, the owner of the property to be burdened by said easement
is willing to grant said easement upon certain terms and conditions; and
WHEREAS, it is in the best interest of the City of Elgin to accept
said temporary access easement upon such conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that Leo Nelson, City Manager, be and is hereby authorized
and directed to execute an acceptance of a temporary access easement from
Leo McGrath, a copy of which is attached hereto and made a part hereof by
reference, and the City Clerk is further authorized and directed to execute
said agreement and affix the city seal thereto.

WILLARD DETENTION ACCESS EASEMENT
That part of the Southwest Quarter of Section 18, Township 41 North,
Range 9 East of the Third Principal Meridian described as follows:
commencing at the Northwest corner of lot 8 of County Clerks division
of unsubdivided land in the South one-half of Section 18-41-9 recorded
June 20, 1895, as document number 2237127; thence South Easterly along
the Northerly line of said lot 8, said line also being the Southerly
right-of-way line of Illinois Rts 19, a distance of 120 feet, more or
less, for the place of beginning; thence continuing Southeasterly, along
the last described course, a distance of 30 feet more or less; thence
Southwesterly, along a line parallel with the West line of said lot 8
line also being the East line of this easement, a distance of 150 feet,
more or less; thence Southerly along a line perpendicular to the South
line of said Section 18 said perpendicular line also being the East line
of this easement, a distance of 245 feet, more or less; thence Westerly,
along a line parallel with the South line of said Section 18 said parallel
line also being the South line of this easement, for a distance of 184
feet, more or less , to the West line of said lot 18; thence Northerly,
along said West lot line, a distance of 60 feet, more or less; thence
East, along a line parallel with said South line of this easement, a
distance of 50 feet, more or less; thence South, along a line parallel
with said East line of this easement, a distance of 30 feet, more or
less, thence East, along a line parallel with said South line of this
easement, a distance of 100 feet, more or less, to a point on a line
parallel with and 30 feet West of said East line of this easement; thence
Northerly, along said parallel line, to the place of beginning.

TEMPORARY ACCESS EASEMENT
This agreement made this day of Re..2L,54-- .
1983 between Mr. Leo McGrath of 945 East Chicago Street, hereafter Grantor
and the City of Elgin, an Illinois municipal corporation, hereafter Grantee.
WITNESSETH
NOW, THEREFORE, in consideration of ten dollars ($10.00) and mutual
promises contained herein the parties agree as follows:
1 . Grantor hereby grants to Grantee temporary access easement
upon, over and across the property shown on the Proposed Access Easement
(Temp) attached hereto and made a part of this agreement to permit the
movement of trucks thereon.
2. This easement shall expire on December 31 , 1984.
3. Grantee shall indemnify and hold harmless Grantor from any
and all damage or personal injury caused by the negligence of Grantee or
its employees or agents in using the easement granted herein.
4. Grantee shall repair any damage to property caused by Grantee's
use of the easement granted herein and shall at the termination of this
agreement return said property as much as reasonably possible to substantially
the same condition it was in on the date this agreement was signed.
IN WITNESS WHEREOF the City Manager and City Clerk have executed this
agreement for and on behalf of the City of Elgin and Leo McGrath have
