This Indenture, made and entered into this 12th day of May, 1981
by and between Fred W. Schuhknecht , hereinafter referred to as
Grantor, and the City of Elgin, a municipal corporation of the State of
Illinois, hereinafter referred to as City.
Witnesseth:
That in and for the consideration of one dollar ($1.00) and other
good and valuable consideration, receipt of which is hereby acknowledged,
Grantor does hereby grant and convey to City a temporary construction ease-
ment in, upon and over the following described real property in the County
of Kane, State of Illinois, more particularly described as a 10.0 foot wide
temporary construction easement running parallel the west right-of-way line
of McLean Boulevard and legally described as:
SEE ATTACHMENT
This grant of temporary easement is executed and granted upon the
following conditions:
1. The City shall occupy and utilize said easement for the purpose
of installing a four (4) foot wide sidewalk within the McLean Boulevard Right-
of-Way and backfilling behind said sidewalk to the existing ground elevation
as part of the McLean Boulevard widening project.
2. The City shall at all times perform all work upon the premises
with reasonable care, skill and diligence and upon completion thereof shall
promptly restore all grounds, ground covering and fences damaged or removed
by City.
3. This easement shall be binding upon the Grantor's successors,
heirs and assigns.
4. All rights granted herein shall be terminated on December 1, 1982.
5. City shall indemnify and hold harmless the Grantor from and
against all claims, suits, damages, costs, losses and expenses resulting from
the use of this easement by the City.
Signed and delivered this 12 day of May, 1982.

41 North, Range 8 East of the Third Principal Meridian
described as follows : Beginning at the intersection of
the South line of said Southwest Quarter with the West
right-of-way line of N . McLean Blvd. ; thence North, along
said West right-of-way line, a distance of 98. 15 feet ; thence
West, along a line parallel with the South line of said South-
west Quarter, a distance of 625.45 feet ; thence Southerly
to a point on the South line of said Southwest Quarter being
622.4 feet West of the place of beginning ; thence East, along
said South quarter section line, a distance of 622.4 feet
to the place of beginning .
