HomeMy WebLinkAbout82-0331 Douglas Avenue Streetscape ga-o33` • RESOLUTION AUTHORIZING AGREEMENTS WITH VARIOUS PROPERTY OWNERS TO SHARE COSTS OF DOUGLAS AVENUE STREETSCAPE WHEREAS, various property owners in the City of Elgin have petitioned the City to construct a local improvement commonly known as the Douglas Avenue Streetscape; and WHEREAS, said property owners have agreed to share the costs of said improvements; and WHEREAS, the City Council of the City of Elgin has determined that it is necessary and desirable that said improvements be made and that the adjoin- ing property owners should bear some of the costs thereof; and WHEREAS, the City of Elgin is a home rule unit by virtue of Article VII of the Illinois Constitution and is thereby empowered to exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, local improvements are matters relating to the government and affairs of the City of Elgin. That City will cause the construction of a local improvement in the public right of way known as Douglas Avenue located between East Chicago Street and Highland Avenue in the City of Elgin, County of Kane, consisting of 12 trees and planters together with complete sidewalk resur- facing, curb and gutter construction and the installation of six light poles and fixtures. 2. That the cost of the improvement described above shall be borne between the City and Owners as follows: City's share shall be 51.7 percent of the actual cost of said improvement and Owners' share, collectively, shall be 48.3 percent of the actual cost of said improvement. 3. That City shall advance and make payment for the entire cost of the improvement and shall be reimbursed by Owners for the Owners' share of the cost of the improvement by payment in seven equal installments with interest at the rate of nine percent per annum; payment of principle and interest shall be made to City on or before January 31,of each year commencing in 1982. 4. Owners' share shall be determined according to the proportion that each Owners' property front footage bears to the total front footage of all properties of Owners. 5. That this agreement, upon execution, shall be recorded with the Recorder of Deeds at Kane County, Illinois and shall constitute and be construed as a lien agreement in lieu of special assessment as security for payment of Owners' share of the improvement described herein. Attached hereto is the legal description of property subject to said lien. The project consists of the addition of twelve street trees and planters together with a complete sidewalk resurfacing and curb and gutter construction. To complete the new look and make it correlate to Fountain Square Plaza, we would also like to install new light poles and fixtures. These new poles would be of the same type used at the north end of the plaza area and along Grove Avenue south of the Clock Tower. We would like to complete this work as soon as possible this Spring. We all feel it will have a positive effect on the downtown business area and provide an indication to our customers and all the people of Elgin that we care about the Central Business District and have faith in its future. Our proposal is that we share the estimated cost of the work in the following proportions: City of Property Improvements Elgin Owners 1. Sidewalks prepared and resurfaced • with 5/8" rustic terrazzo from curb to storefronts, a distance of approx- imately 530 lineal feet. $21, 800 $21, 800 2. New curbs and gutters 9, 700 3. That the cost of the improvement described above shall be borne between the City and Owners as follows: City's share shall be 51.7 percent of the actual cost of said improvement and Owners' share, collectively, shall be 48.3 percent of the actual cost of said improvement. 3. That City shall advance and make payment for the entire cost of the improvement and shall be reimbursed by Owners for the Owners' share of the cost of the improvement by payment in seven equal installments with interest at the rate of nine percent per annum; payment of principle and interest shall be made to City on or before January 31 ,of each year commencing in 1982. 99068 f 1 , • 4.
