RESOLUTION
AUTHORIZING A TRAFFIC SIGNAL AGREEMENT WITH THE STATE OF ILLINOIS,
DEPARTMENT OF TRANSPORTATION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that Richard L. Verbic, Mayor, and Marie Yearman, City Clerk, be and
are hereby authorized and directed to execute an agreement on behalf of
the City of Elgin with the State of Illinois, Department of Transportation,
for the installation and maintenance of traffic signals on Illinois
Route 31 at Airport Road-Tollgate Road in the City of Elgin, a copy of
said agreement is attached hereto and made a part hereof by reference.

• AGREEMENT ----_This agreement entered into this Z 4 A day of M Q,reh A.D. , 19182r, by..and between
the STATE OF ILLINOIS, acting by and through its Department of Transportation, hereinafter
called the STATE, and the CITY OF ELGIN, of Kane County, of the State of Illinois, here-
inafter called the CITY.
WITNESSETH:
WHEREAS, the STATE, in order to facilitate the free flow of traffic and insure safety
to the motoring public, is desirous of improving the intersection of Illinois Route 31
(FAP Route 860) and Airport Road-Tollgate Road by installing permanent traffic control
signals (to be known as STATE Section N-4-D-TS(80) and as CITY Section 81-00121-00-TL) ,
installing Emergency Vehicle Priority System, and by performing all other work necessary
to complete the improvement in accordance with the plans and specifications; and,
WHEREAS, the CITY is desirous of said improvement in that same will be of immediate
benefit to the residents of the CITY, and permanent in nature; and,
WHEREAS, the intersection of Illinois Route 31 and Airport Road-Tollgate Road lies
within the corporate limits of the CITY.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties
hereto agree as follows:
1. The STATE agrees to prepare plans and specifications, receive bids, award the contract,
furnish engineering inspection during construction, and cause the improvement to be
built in accordance with the plans, specifications, and contract. The STATE also
agrees to pay all construction and engineering costs subject to reimbursement by
the CITY as hereinafter stipulated.
2. The CITY agrees to approve the plans and specifications by letter or resolution prior
to the STATE advertising for the work to be performed hereunder.
3. It is mutually agreed that the CITY shall be financially responsible for the entire
construction costs and engineering costs of the Emergency Vehicle Priority System.
4. It is mutually agreed that the proportional participation for the construction costs
and engineering costs of these improvements shall be as follows:

5. It is mutually agreed that the estimated construction costs and engineering costs
of these improvements are as follows:

'6. It is mutually agreed that the CITY will reimburse the STATE in an amount equal to
the CITY'S share of the actual cost as determined in accordance with Items 3, 4, and
5 above. It is mutually agreed that upon award of the contract for this improvement,
the CITY will pay to the Department of Transportation of the State of Illinois, in
a lump sum from any funds allotted to the CITY, under the Motor Fuel Tax Law, an
amount equal to 95% of its obligation incurred under this agreement, and will pay
to the said Department the remainder of its obligation (including any non-partici-
pating costs for FA projects) in a lump sum, upon completion of the project based
upon final costs.
7. The CITY has passed a resolution appropriating sufficient funds to pay its share of
the cost of these improvements, a copy of which is attached hereto as "Exhibit A"
and made a part hereof.
8. This improvement will also include roadway work to facilitate the installation of
detection equipment.
9. Upon the completion of these improvements, the STATE shall maintain and be finan-
cially responsible for the maintenance costs of the traffic signals.
10. It is mutually agreed that the financial responsibility for the maintenance of
the Emergency Vehicle Prioity System shall be borne entirely by the CITY.
11. The STATE'S Electrical Maintenance Contractor shall maintain the Emergency Vehicle
Priority System located at the traffic signal installation to be maintained by the
STATE. The STATE'S Electrical Maintenance Contractor shall invoice the CITY for the
maintenance costs related to the maintenance of the Emergency Vehicle Priority
System. The CITY shall maintain the emitters and associated appurtenances at its
own expense. The emitters shall be maintained and tested by the CITY in accordance
with the recommendations of the manufacturer and shall submit a letter to the STATE'S
Electrical Maintenance Contractor on the first day of every month certifying that
the emitters are operating in accordance with the manufacturer's specifications.
The letter shall list all CITY vehicles equipped with emitters and the operational
status of each emitter.
12. It is mutually agreed that the STATE'S Electrical Maintenance Contractor will send
to the CITY an itemized invoice every three months covering-the actual cost for
the maintenance of the Emergency Vehicle Priority System during the preceding period.
Upon receipt of said invoice, the CITY agrees to pay to the STATE'S Electrical Main-
tenance Contractor the amount of the invoice by certified check.
13. It is mutually agreed that the financial responsibility for the energy charges for
the operation of the traffic signals and Emergency Vehicle Priority System shall be
borne entirely by the CITY.
14. The STATE agrees to make arrangements with the local power company to furnish elec--
trical energy for the operation of the traffic signals and Emergency Vehicle Priority
System and to bill the CITY for the entire cost of the energy charges.
15. The STATE will be responsible for maintenance of lane line and median line markings.
The CITY will be responsible for maintenance of crosswalk and stop line markings.
16. The STATE retains the right to control the sequence and timing of the traffic signals.
17. The CITY has adopted and will put into effect, prior to advertising for the work to
be performed hereunder, an ordinance requiring that parking be prohibited adjacent
to this improvement on the approaches lying within the corporate limits of the CITY,
a copy of which is attached hereto as "Exhibit B" and will, in the future, prohibit
parking at such locations on or immediately adjacent to this improvement as may be
determined to be necessary by the STATE from traffic capacity studies.

18. The CITY agrees to exercise its franchise right to cause private utilities to be
relocated at no expense to the STATE.
19. The STATE agrees to comply with all applicable Executive- Orders and Federal Highway
Acts pursuant to the Equal Employment Opportunity and Nondiscrimination Regulations
required by the U.S. Department of Transportation.
20. This agreement and the covenants contained herein shall become null and void in the
event the contract covering the construction work contemplated herein is not
awarded by June 30, 1984.
21. This agreement shall be binding upon and inure to the benefit of the parties hereto,
their successors and assigns.

• EXHIBIT A
WHEREAS, the CITY of Elgin has entered into an Agreement with the State of Illinois
for the installation of permanent traffic control signals at the intersection of Illinois
Route 31 at Airport Road-Tollgate Road, known as STATE Section N-4-D-TS(80) and as CITY
Section 81-00121-00-TL; and,
WHEREAS, in compliance with the aforementioned Agreement, it is necessary for the
CITY to appropriate sufficient Motor Fuel Tax Funds to pay its share of the cost of
said traffic signal improvements.
NOW, THEREFORE, BE IT RESOLVED, that there is hereby appropriated the sum of
THIRTEEN THOUSAND FIVE HUNDRED AND NO/100 DOLLARS ($13,500.00) or so much thereof as may
be necessary, from any money now or hereinafter allotted to the CITY, under provisions
of the Motor Fuel Tax Law, to pay for its share of the cost of this improvement as
provided in this Agreement; and,
BE IT FURTHER RESOLVED, that upon award of the contract for this improvement, the
CITY will pay to the Department of Transportation of the State of Illinois, in a lump
sum from any funds allotted to the CITY, under the Motor Fuel Tax Law, an amount equal
to 95% of its obligation incurred under this Agreement, and will pay to the said Depart-
ment the remainder of its obligation (including any non-participating costs for FA
projects) in a lump sum, upon completion of the project based upon final costs; and,
BE IT FURTHER RESOLVED, that the CITY agrees to pass a supplemental resolution to
provide necessary funds for its share of the cost of this improvement if the amount
appropriated herein proves to be insufficient to cover said cost.
