GRANT OF PERMANENT UTILITY I ;SST
THIS INDENTURE made and entered into this (/Tw day of MV6"56.4, ,
1980, by and between Delwin S. Neil and Jeanne S. Neil, his wife, of- the City
of Elgin, Illinois, hereinafter called Grantor, and the City of Elgin, a
municipal corporation, hereinafter referred to as City, Witnesseth:
That in and for the consideration of one dollar ($1.00) and other
good and valuable consideration, receipt of which is hereby acknowledged,
Grantor does hereby grant and convey to City a permanent utility easement for
the construction, maintenance and operation of electric utility lines in and --
upon the following described real property in the City of Elgin, County of
Kane, State of Illinois, more particularly described as: Cr)
An easement over the northerly 4.72 feet (as measured at
right angles to the north line thereof) of a tract of land known a'
as lot 8, in block 10 of J. T. Gifford's Plat of East Elgin, in
the City of Elgin, Kane County, Illinois.
This grant of easement is executed, delivered and is granted upon
the following conditions:
1. Grantors agree that no building will be constructed ova this o rri

2. The City will at all times prosecute all work upon there{Ases: o
with reasonable care, skill and diligence and upon completion thereof
promptly restore the surface of said property �

This permanent easement shall be binding upon the Grantors"'an upon
their heirs, executors, successors and assigns. o 0
