RESOLUTION
ACCEPTING GRANTS OF EASEMENTS
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that it hereby accepts a grant of permanent easement from Chicago Rawhide
Manufacturing Company, Inc. , for the operation and maintenance of a lime
residue transmission main, a copy of which is attached hereto as Exhibit A.
BE IT FURTHER RESOLVED that it hereby accepts a temporary construction
easement from Chicago Rawhide Manufacturing Company, Inc. , for the construc-
-tion of a lime residue transmission main, a copy of which is attached hereto
as Exhibit B.
BE IT FURTHER RESOLVED that the City Council is hereby authorized and
directed to cause the grants of easements hereby accepted to be recorded in
the office of the Recorder of Deeds of Kane County, Illinois.

GRANT OF PERMANENT EASEMENTS
This Indenture, made and entered into this 21st day of April,
1981, by and between Chicago Rawhide Manufacturing Company, Inc. , a
corporation created and existing under and by virtue of the laws of the
State of Illinois and duly authorized to transact business in the State
of Illinois, hereinafter referred to as Grantor, and the City of Elgin, a
municipal corporation of the State of Illinois, hereinafter referred to
as City,
Witnesseth:
That in and for the consideration of one dollar ($1.00) and other
good and valuable consideration, receipt of which is hereby acknowledged,
Grantor does hereby grant and convey to City easements in, upon and over
the following described real property in the City of Elgin, County of Kane,
State of Illinois, more participarly described as:
Easement Number 1:
A Permanent Easement over that part of the West half of Section 11,
Township 41 North, Range 8 East of the Third Principal Meridian described
as follows: Commencing at the intersection of the Northerly right of way
line of the Chicago and Northwestern Railway with the West line of said
Section 11; thence Northerly, along the West line of said Section 11, a
distance of 414.12 feet; thence Northeasterly, along a line that forms
an angle of 18 degrees 36 minutes 45 seconds to the right with the prolonga-
tion of the last described course, a distance of 559.16 feet to the North-
erly right of way line of the Chicago, Milwaukee, St. Paul and Pacific Rail-
road for the place of beginning; thence Northeasterly, along a continuation
of the last described course, a distance of 85.28 feet (this course herein-
after referred to as Line "A") to a point on a line that is 30.0 feet
Southerly of (measured radially thereto) and parallel with the Southerly
right of way line of Big Timber Road; thence Easterly, along said parallel
line, being along a curve to the right, a distance of 32.55 feet; thence
continuing Easterly, along said parallel line, being tangent to the last
described curve, a distance of 43.58 feet; thence continuing Easterly, along
said parallel line, being along a curve to the left, a distance of 181.06
feet to a point on the Southerly extension of a jog in the Southerly right
of way line of Big Timber Road; thence Northerly, along the Southerly

of way line,being along a curve to the left, a distance of 404.09 feet to
a jog in said Southerly right of way line; thence Northerly, along said jog,
a distance of 20.0 feet; thence Easterly, along the Southerly right of way

113.65 feet; thence continuing Easterly, along said Southerly right of way
line, being tangent to the last described curve, a distance of 580.25 feet
to the Northwest corner of a tract of land conveyed to National Boulevard
Bank of Chicago Trust No. 4916, recorded January 28, 1974 as Document No.
1288067; thence Southerly, along the West line of said National Boulevard
Bank of Chicago Trust No. 4916 tract, being at right angles to the last
described course, a distance of 10.0 feet; thence Westerly, parallel with
the Southerly right of way line of Big Timber Road, a distance of 580.25
feet; thence continuing Westerly, parallel with said Southerly right of
way line, being along a curve to the right, a distance of 83.80 feet,to a
point on a line that is 30.0 feet Easterly of (measured at right angles
thereto) and parallel with a jog in the Southerly right of way line of Big
Timber Road; thence Southerly, along said parallel line, a distance of 20.0 feet;
thence Westerly, parallel with the Southerly right of way line of Big Timber Road,
being along a curve to the right, a distance of 404.61 feet to a point on
a line that is 30.0 feet Easterly of (measured at right angles thereto)

last described curve, a distance of 43. 58 feet; thence continuing
Westerly, along said parallel line, being along a curve to the left, a
distance of 14.07 feet,to a point on a line that is 20.0 feet South-
easterly of (measured at right angles thereto) and parallel with Line "A",
as aforesaid; thence Southwesterly, along said parallel line, a distance
of 77.21 feet,to the Northerly right of way line of the Chicago, Milwaukee,
St. Paul and Pacific Railroad; thence Northwesterly, along said Northerly
right of way line, being along a curve to the left,a distance of 20.04 feet
to the place of beginning.
Easement Number 2:
A Permanent Easement over that part of the West half of Section 11,
Township 41 North, Range 8 East of the Third Principal Meridian, described
as follows: Beginning at the intersection of the Northerly right of way
line of the Chicago and Northwestern Railway with the West line of said
Section 11; thence Northerly, along the West line of said Section 11, a
distance of 414.12 feet; thence Northeasterly, along a line that forms an
angle of 18 degrees 36 minutes 45 seconds to the right with the prolonga-
tion of the last described course, a distance of 409.27 feet (this course
hereinafter referred to as Line "A"),to the Southerly right of way line of
the Chicago,Milwaukee, St. Paul and Pacific Railroad; thence Southeasterly,
along said Southerly right of way line, being along a curve to the right, a distance
of 20.05 feet to a point on a line that is 20.0 feet Southeasterly of
(measured at right angles thereto) and parallel with Line "A" as aforesaid;
thence Southwesterly, along said parallel line, a distance of 438.73 feet
to a point on a line that is 10.0 feet Easterly of (measured at right angles
thereto) and parallel with the west line of Section 11, Township and Range
aforesaid; thence Southerly, along said parallel line, a distance of 385.0
feet to the Northerly right of way line of the Chicago and Northwestern
Railway; thence Northwesterly, along said Northerly right of way line,
being along a curve to the left, a distance of 10.72 feet to the place of
beginning.
This grant of easements is executed and granted upon the follow-
ing conditions:
•
1. Grantor agrees that no building will be constructed over
said easements.
2. City shall at all times prosecute all work upon the premises
with reasonable care, skill and diligence and upon completion thereof will
promptly restore all grounds, ground coverings and fences.
3. City shall indemnify and save harmless the Grantor from and
against all claims, suits, damages, costs, losses and expenses resulting
from or connected with construction or maintenance of pipelines within said
easements.
4. Grantor agrees to allow access to easement number 2 from the
entrance to Grantor's parking area of State Route 31 through the existing
paved parking area to the southwest corner of said parking area along the
northerly right of way line of the Chicago and Northwestern railway to said

easement upon the condition that the existing fence be replaced after its
removal for access.
This easement shall be binding upon the Grantor's successors
and assigns.
IN WITNESS WHEREOF, said Grantor has caused its corporate seal
to be hereto affixed, and has caused its name to be signed to these
presents by its President and attested by its Secretary.

This Indenture, made and entered into this 21st day of April,
1981, by and between Chicago Rawhide Manufacturing Company, Inc. , a

Grantor does hereby grant and convey to City temporary construction easements
in, upon and over the following described real property in the City of Elgin,

A 30.0 foot wide Temporary Construction Easement, lying Southerly
