HomeMy WebLinkAbout81-0501 Pee Wee Football 81� osal • LEASE By this lease made and entered into this 1st day of May, 1981, between the City of Elgin, a municipal corporation of the State of Illinois, hereinafter called "Lessor," and the Elgin Pee-Wee Football League, Inc. , a not-for-profit corporation of the State of Illinois, hereinafter called "Lessee," Lessor, for and in consideration of the rent hereinafter specified and the covenants and agreements hereinafter contained, leases to Lessee the premises legally described as follows: Of part of the Supervisor Assessment Plat, County Clerk Lots Number 346 through 360 of the Southeast quarter of Section 24, Township 41 North, Range 8 East of the Third Principal Meridian and part of the County Clerk's Division of unsubdivided land in Section 19, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the Northeast corner of Lot 1, Block 1 of Redeker's Addition to Elgin, being also a point on the Southerly line of Hastings Street; thence Easterly, along said Southerly line, a distance of 554.0 feet for the place of beginning; thence Southerly, along a line that if extended South- 1 erly, would intersect the Northerly line of the U.S. Route 20 Bypass at a point 545. 0 feet Easterly of (as measured along said Northerly line) the Easterly line of Redeker's Addition to Elgin, a distance of 100.0 feet; thence Easterly, parallel to the South- erly line of Hastings Street, a distance of 90.0 feet; thence Northerly, a distance of 100.0 feet to a point on the Southerly line of Hastings Street that is 90.0 feet Easterly of (as measured along said Southerly line) , the place of beginning; thence Westerly, along said Southerly line, a distance of 90.0 feet to the place of beginning. Being situated in the City of Elgin, Kane and Cook Counties, Illinois and containing 0.207 Acre more or less. 1. The term of this lease shall be for twenty (20) years from the date of this lease. 2. Lessee agrees to pay, without demand, to Lessor as rent for the premises the sum of one thousand dollars (81,000.00) per year payable on the first day of May of 1981, 1982, 1983 and 1984 and one dollar ($1.00) payable each May 1, for each remaining year. Payments shall be made to the Finance Director, City of Elgin, 150 Dexter Cotirt , Elgin, Illinois. 3. Said premises shall be used for offices , storage space and locker rooms for the football league and as a concession sales area and for no other purpose whatsoever without the written consent of Lessor. 4. Lessor agrees to pay all electric bills for lighting of the premises. 5. Lessee may, at Lessee's sole cost and expense, make such changes, alterations or improvements as may be necessary to fit said premises for such use, and all fixtures and improvements installed by Lessee shall remain the property of Lessee, who may remove the same upon the termination SCMI"D — 01 Y 1 D w of this lease, provided, that such removal shall be done in such a. manner as not to injure or damage the premises. 6. Lessee represents that Lessee has inspected and examined the premises and accepts them in their present condition, and agrees that Lessor shall not be required to make any improvements or repairs whatsoever in or upon the premises or any part thereof. 7. Lessee covenants and agrees: To pay for all utility services required on the premises except electricity for lighting. b. To keep said premises safe and in good order at all times during the term hereof and upon expiration of this lease, the Lessee shall quit and surrender possession of said premises quietly and peace- ably and in good order and condition reasonable wear, tear and damage excepted. c. To obtain and maintain in force and effect at all times a policy of liability insurance for the premises acceptable to Lessor and having Lessor as an additional insured. d. To maintain the exterior grounds of the premises including the trimming of grass, shrubs and trees and the removal of snow from all sidewalks, stairs and entranceways. e. To not assign or sublet the premises or any part thereof. f. To comply with all ordinances, laws, rules and regulations which may pertain or apply to the premises and the use thereof. 8. If any default is made in the payment of rent in the performance of or compliance with any other term or condition thereof, this lease, at the option of Lessor, shall terminate and be forfeited, and Lessor may re-enter the premises. Lessee shall be given written notice of any default or breach, and termination and forfeiture of the lease shall not result if, within thirty (30) days of receipt of such notice, Lessee has corrected the default or breach or has taken action reasonably likely to effect such correction within a reasonable time. 9. In the event of any default or breach by the Lessor of any term or condition of this agreement, Lessee may terminate the agreement and Page 2 of 3 vacate the premises without further obligations, provided Lessee has given Lessor written notice of any default or breach and Lessees intention to terminate and Lessor has failed to correct the default or breach or has taken action reasonably likely to effect such correction within a reason- able time. 10. Waiver by Lessor of any default in performance by Lessee of any of the terms, covenants, or conditions contained herein, shall not be deemed a continuing waiver of the same or any subsequent default herein.
