HomeMy WebLinkAbout80-1224 ECC Parking corporation of the State of Illinois (hereinafter called the "City") and the Board of Trustees of Community College District No. 509, County of Kane, State of Illinois, a body politic and corporate of the State of Illinois (hereinafter called "Owner") . WITNESSETH: WHEREAS, Community College District 509 is the owner of real property which includes a parking area located within the corporate limits of the City and which is legally described as follows: That part of the South half of Section 21 and part of the Southwest quarter of Section 22, all in Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the Southwest corner of the Northeast quarter of the Southwest quarter of said Section 21; thence Northerly along the West line of the Northeast quarter of the Southwest quarter of said Section 21, a distance of 624.99 feet to a point on a line that is 30.00 feet Southerly of (measured at right angles thereto) and parallel with the Northerly line of property now owned by the State of Illinois, for the place of beginning; thence Easterly, along said parallel line, a distance of 1523.01 feet; thence Southeasterly along a curve to the right having a radius of 450.0 feet and being tangent to the last described course, a distance of 486.33 feet; thence Southeasterly, tangent to the last described curve, a distance of 851.20 feet; thence Southeasterly along a curve to the left having a radius of 875.0 feet and being tangent to the last described course, a distance of 932.73 feet; thence East- erly, tangent to the last described curve, a distance of 746.22 feet; thence Northeasterly along a curve to the left having a radius of 750.0 feet and being tangent to the last described course, a distance of 490.84 feet; thence Northeasterly, tangent to the last described curve, a distance of 1285.00 feet; thence Northeasterly and Easterly along a curve to the right having a radius of 500.0 feet and being tangent to the last described course, a distance of 405.79 feet to a point on a line that is 30.0 feet Southwesterly of (measured at right angles thereto) and parallel with the Northeasterly line of lands conveyed by George D. Carbary and Lillian L. Carbary to the State of Illinois by Document No. 498148; thence Southeasterly along said parallel line, a distance of 353 feet more or less to the center line of McLean Boulevard (State Aid Route 18) ; thence Northeasterly along said center line, a distance of 30.0 feet to the Northeasterly line of lands conveyed by George D. Carbary as aforesaid; thence Northwesterly along said Northeasterly line, a distance of 356.5 feet to the Easterly line of the State of Illinois property as aforesaid; thence Northeasterly along said Easterly line, being along a line that forms an angle of 89 degrees 28 minutes to the right with the prolongation of the last described course, a distance of 461. 2 feet to the North line of said State of Illinois property; thence Westerly along said North line, a distance of 5779.65 feet to the West line of the Northeast quarter of the Southwest quarter of said Section 21; thence Southerly along said West line, a distance of 30.01 feet to the place of beginning. Being situated in Elgin Township, Kane County, Illinois, and containing 100.005 Acres more or less. and 1570996 PalCAL-t7, Lne LILy L0UnC11 oI Lne LiLy ana Lne Wan' 01 1 L US tees of Community College District 509 have authorized the ratification of the terms, provisions and conditions of this Agreement. NOW, THEREFORE, in consideration of the mutual covenants and agree- ments herein contained, the parties hereto agree as follows: 1. The City hereby agrees to establish and enforce the following regulations within the college campus: a. The stopping, standing or parking of any motor vehicle in a fire lane, as shown on Exhibit A attached hereto and made a part hereof, shall be prohibited. 2. The Owner does hereby agree to erect signs relating to the aforesaid regulations at appropriate places within the college campus. 3. The Owner does hereby agree to bear the costs and expenses of obtaining, erecting and maintaining any and all signs necessary to the enforcement of the aforesaid regulations. 4. The City hereby agrees to regulate the parking of automobiles and enforce the aforesaid regulations. 5. It is mutually agreed that this agreement shall cover a period of one (1) year from the date hereof and shall be selfrenewing for periods of one (1) year each thereafter, not to exceed a period of 20 years, unless and until cancelled by not less than thirty (30) days' written notice by either party to the other of its intention to cancel same, in which case, the agreement shall terminate on the first day of January in the year next follow- ing the filing of the cancellation notice. 6. Whenever notice to the City is required, it shall be addressed to: City Clerk City of Elgin 150 Dexter Court Elgin, Illinois When notice to the Owner is required it shall be addressed to: Director of Operation Elgin Community College 1700 Spartan Drive Elgin, Illinois 1570990 -2- ment, the parties hereto do hereby certify that each has passed a proper resolution authorizing the execution and ratifying the terms, provisions and conditions of this agreement. 8. The sole remedy available to the Owner, upon any breach of this agreement by the municipality, shall be the cancellation of the agree- ment under its terms. It is of the essence of this agreement, that the municipality shall not be liable in money damages for any breach of this agreement.
