SUPPLEMENTAL AGREEMENT NUMBER TWO
BETWEEN THE
CITY OF ELGIN, ILLINOIS
TOWNSHIP OF ELGIN, KANE COUNTY, ILLINOIS
COUNTY OF KANE, ILLINOIS
AND
DEPARTMENT OF TRANSPORTATION, STATE OF ILLINOIS
This Supplemental Agreement between the City of Elgin, Illinois
(CITY) ; the Township of Elgin, Kane County, Illinois (TOWNSHIP) ; the
County of Kane, Illinois (COUNTY) , and the Division of Water Resources
(WATER RESOURCES) and Division of Highways (HIGHWAYS) , both being
of the Department of Transportation, State of Illinois (STATE) , is made
and entered into for the purpose of extending the original Agreement of
December 1, 1977, between said parties.
WHEREAS, the original Agreement of December 1, 1977, provides for
the construction completion of Sections B, C, D, and E of the proposed
flood control and drainage improvement covered thereunder prior to
December 1, 1978, extended to December 1, 1979, by Supplemental Agreement
Number One; and,
WHEREAS, HIGHWAYS has completed construction of Section B; and,
WHEREAS, COUNTY is withholding construction of Section E in order to
coordinate such with the construction of Sections C and D which is the
responsibility of CITY; and,
WHEREAS, CITY is involved in a condemnation suit for certain property
requiredonstruct Sections C and D which has delayed the project, and
said CITY, under letter of October 23, 1979, requests an extension of the
December 1, 1979, deadline in which to complete construction of said
Sections C and D.
NOW THEREFORE, for and in consideration of the benefits to be
derived from the completion of the flood control and drainage improvement

covered under the Agreement of December 1, 1977, it is hereby agreed
by the parties thereto that in each instance therein the completion
date of December 1, 1978, extended to December 1, 1979, by Supplemental
Agreement Number One, is hereby changed to December 1, 1980. This
Supplemental Agreement does not change, alter or revise any other
provision of the original Agreement.
IN WITNESS WHEREOF, the parties hereof have executed this

RESOLUTION
AUTHORIZING A SUPPLEMENTAL AGREEMENT WITH THE
TOWNSHIP OF ELGIN, COUNTY OF KANE AND DEPARTMENT OF
TRANSPORTATION, STATE OF ILLINOIS
WHEREAS, the City of Elgin, Township of Elgin, County of Kane,
and Department of Transportation, State of Illinois, have heretofore
entered into a written agreement dated December 1, 1977 for the con-
struction of certain drainage improvements; and
WHEREAS, it is necessary and desirable to extend the time for
completion of said improvement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that Leo I. Nelson, City Manager, and Marie Yearman,
City Clerk, be and are hereby authorized and directed to execute Supple-
mental Agreement Number Two on behalf of the City of Elgin, a copy of
which is attached hereto and made a part hereof by reference.

RESOLUTION NO.77-124
Approving Joint Agreement for Improvement of Otter Creek Drainage
•
WHEREAS, the County Board of Kane County, Illinois is aggreable to a cooperative
storm drainage improvement project of Otter Creek Basin involving the Illinois
Division of Water Resources, Illinois Division of Highways, City of Elgin, Elgin
Township and County of Kane, as detailed in the joint agreement, and
WHEREAS, the portion of the improvement assumed by the Kane County Highway
Department is the construction of a double concrete box culvert across the Randall
Road right-of-way north of South Street near the City of Elgin. The estimated
cost for this work is $80,000 payable from County Bridge Funds.
NOW, THEREFORE, BE IT RESOLVED that the Chairman of the County Board be, and he
is hereby is authorized to execute such a joint agreement.
