HomeMy WebLinkAbout79-1001 Humane Society AGREEMENT This agreement made this 1st day of October, 1979 between the City of Elgin, a municipal corporation of the State of Illinois, herein- after referred to as "City of Elgin" and the Human Society of North Central Illinois, 100 South LaFox Street, South Elgin, Illinois, an Illinois not-for-profit corporation, hereinafter referred to as "Humane Society-". WITNESSETH 1HEREAS, the City of Elgin requires a location for dogs found to be at large or otherwise in need of impoundment; and WHEREAS, the Human Society operates an animal shelter for the care, treatment and protection of animals; and WHEREAS, the City of Elgin desires the Humane Society to impound at its facilities dogs from the City of Elgin. NOW, THEREFORE, in consideration of the mutual covenants herein- after set forth, the parties hereby agree as follows : 1. The Human Society agrees that during the term of this agree- ment to perform the following duties: A. Construct, equip and maintain an addition to its shelter to provide adequate facilities for all animals impounded from the City of Elgin. B. Maintain suitable office hours at the Humane Society's facilities for the convenience of the public and for the purpose of transacting busi- ness in connection with the duties under this agreement and for the purpose of impounding or redeeming animals. C. To hold all dogs impounded by the City of Elgin as provided for by the ordinances of the City of Elgin before selling or otherwise disposing of said dog unless euthansia is necessary for humane reasons. D. To provide proper food, water, shelter and humane care for all dogs brought to the Humane Society's facilities while such animals are in the Humane Society's possession and until they are redeemed, placed or otherwise humanely disposed of in accordance with the applicable laws and ordinances. E. To ratify owners of impounded dogs of their impoundment as required by the ordinances of the City of Elgin. • F. To comply with all animal regulation laws of the State of Illinois and the City of Elgin now in effect or hereinafter enacted. G. To cooperate with the Animal Control Officer of the City of Elgin for the proper enforcement of all ordinances of the City of Elgin. H. To issue licenses to dogs kept in the City of Elgin. I. To collect all fees and fines as provided by ordinance and to keep proper financial records. The City of Elgin shall have the right to inspect and audit the Humane Society's records kept pursuant to this agreement. J. To submit an annual report to the City of Elgin. K. To submit a copy of its articles of incorporation. L. (indemnity) 2. The City of Elgin agrees that during the term of this agreement to perform the following duties: A. To pay to the Humane Society a fee of Thirty Dollars ($30.00) per dog that is not redeemed withi ours. This fee shall cover the total cost of the food, shelter and veterinary care for each animal. No charges shall be assessed against the City of Elgin for dogs given directly to the Humane Society. B. To supply to the Humane Society all necessary dog licenses, tags and receipt forms for the licensing of dogs as provided in this agreement. C. To furnish to the Humane Society all ordinances dealing with animals and to promptly furnish the society with copies of all new ordinances or amendments. 3. The City of Elgin agrees that to assist the Humane Society perkx&‘) i/3* to construct an addition to its present facilities, to prepay to the e A Society the amount of One Hundred Thousand Dollars ($100,000.00) toward future impoundment fees. 4. This agreement shall continue until the accrued impoundment charges equal the City of Elgin's prepayment as described in paragraph 3. 5. If at any time the Humane Society is unable to fulfill its duties under this agreement, the Humane Society shall refund the balance of the prepayed impoundment fees to the City of Elgin. -2- M 6. The Humane Society agrees to mortgage its real property to the City of Elgin in the amount of One Hundred Thousand Dollars ($100,000.00) as a guarantee should repayment be necessary under the provisions of paragraph 5.
