GRANT OF EASEMENT
The Grantor, ROBERT O. SCHAEFFER, TRUSTEE OF THE OT.LTF
SCHAEFFER TRUST, DATED AUGUST 19, 1972,
for and in consideration of the sum of One and 00/100 Dollars ($1.00) and
other good and valuable consideration, receipt of which is hereby acknowl-
edged, does hereby grant and convey to the City of Elgin, a municipal cor-
poration, duly organized and existing under and by virtue of the Constitu-
tion of the State of Illinois, a perpetual easement for the operation,
removal, repair and maintenance of underground storm sewers, together with
all necessary appurtenances, 'across, through and under the following
described real property in the City of Elgin, County of Cook, State of
Illinois, more particularly described as follows:
A 10 foot wide (as measured at right angles) perpetual
easement for storm sewer purposes over part of the South
Half of Section 7, Township 41 North, Range 9 East of the
Third Principal Meridian, the center line of said easement
being described as follows: Commencing at the Northeast
corner of Lot 89 in Parkwood Unit No. 1, being a subdivision
of part of the Northeast Quarter and part of Government Lot 1 H
of the Northwest Quarter of Section 18, Township and Range
aforesaid; thence Westerly along the North line of said (n
Lot 89, a distance of 5.0 feet; thence Northerly at right
angles to said North line, a distance of 5.0 feet for the
place of beginning of said center line; thence Easterly along cy
said center line, parallel with the North line of said Parkwood
Unit No. 1 a distance of 39.68 feet; thence Northerly along said
center line a distance of 538 feet, more or less to a point on
the South line of the Evanston Highway (State Route 58) that is
321.0 feet Westerly of (as measured along said South line) the
West line of Waverly Drive as dedicated by Document No. 21330211,
for the terminus of said center line, in Cook County, Illinois.
This grant of easement is executed, delivered and granted upon
the following terms and conditions:
Grantor, its successors and assigns, hereby releases the City
of Elgin, its agents and employees, assigns and successors, from any and
all liability for damage to our remaining lands resulting from this con-
veyance
The Grantor agrees that no buildings will be constructed over
this easement.
By the acceptance of this Grant of Easement, the City of Elgin
agrees to indemnify and hold harmless Grantor from all claims, actions,
suits, damages and demands arising out of or related to the use and
maintenance by the City of Elgin of the easement granted, including all

costs, expenses and reasonable attorneys' fees incurred in investigating,
defending or settling any such matters and protecting Owner's rights
provided written notice shall be given the City of Elgin of any such matter
in a timely manner.
