RESOLUTION
AUTHORIZING A SUPPLEMENT TO AN AGREEMENT WITH THE
CHICAGO, MILWAUKEE, ST. PAUL AND PACIFIC RAILROAD COMPANY
WHEREAS, the City of Elgin has heretofore entered into an agree-
ment with the Chicago, Milwaukee, St. Paul and Pacific Railroad Company •
for the granting by the railroad to the city a temporary construction
easement along Big Timber Road and a license right to install, construct
and maintain drainage facilities located on the right of way; and
WHEREAS, the City of Elgin has requested additional authority to
install storm sewers parallel to and north of the railroad tracks:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that Leo I. Nelson, City Manager, be and is hereby
authorized and directed toexecute acceptance of a supplemental letter
of agreement dated June 4, 1979 with the Chicago, Milwaukee, St. Paul
and Pacific Railroad Company, a copy of which is attached hereto and made
a part hereof by reference.

Dear Mr. Dahl:
Reference is made to the City's letter of May 23, 1979, requesting a
license to install a storm sewer parallel to and north of our tracks
as part of the subject project.
It is our understanding that the City desires to install approximately
820 feet of 24 inch concrete storm sewer and approximately 280 feet of
36 inch concrete storm sewer on Railroad right-of-way as shown in yellow
on the attached plan marked Exhibit "X" dated 5/22/79. Catch basins
within Big Timber Road would be connected to the sewer by laterals. The
storm sewer would also carry McLean Blvd. surface drainage and our sub-
surface drainage from the grade crossing area.
The City and Railroad are parties to an Agreement which provides, in
part, for granting by the Railroad to the City of a temporary construction
easement along Big Timber Road and a license right to install, construct
and maintain on railroad right-of-way such drainage facilities as may be
required to drain said right-of-way at the McLean Blvd. grade crossing.
The license right is terminable only upon mutual agreement between the 1
City and Railroad or upon need of the property for other rail related
purposes.
The existing agreement contains provisions for protection of Railroad
traffic and facilities during work by any contractor or contractors for the
City. We have no objection to the proposed construction of the storm sewer
as shown in yellow on attached Exhibit "X" under the grantings and provisions
of the existing agreement. The City's contractor shall be responsible for
protection of the Railroad's poleline, other facilities and rail traffic
during construction, and the City shall be responsible for the maintenance
and operation of the storm sewer after construction is completed.

This letter is furnished in duplicate as a proposed supplement to the
existing agreement. If the proposal is acceptable to the City, please
have both letters signed and return one to this office so that we can
attach it to the Railroad 's copy of the executed agreement.
