HomeMy WebLinkAbout79-0215 CNA Realty Recorded Jr FILED FOR REDO KANE COINY>'�'� 1 5 0 1 3 6 0 1979 APR 24 PM 2 00 GRANT OF EASEMENT RECORDER OF DEEDS THIS AGREEMENT made this 15th day of February, 1979, by CNA REALTY CORPORATION, a Delaware corporation, First Party, and the CITY OF ELGIN, a municipal corporation, Second Party. WHEREAS, First Party is the owner of a fee simple interest in the parcel of land described as follows: Lots 35, 36, and 37 in North Elgin Industrial Plaza, being a subdivision of parts of Sections 33 and 34, Township 42 North, Range 8 east of the Third Principal Meridian, according to the plat of aforesaid subdivision thereof, recorded on September 17, 1973 as Document No. 1278513 in the City of Elgin, Kane County, Illinois. WHEREAS, a retention basin is located on Lots 36 and Lots 37 on the property described aforesaid which is being dedicated to the CITY OF ELGIN by Plat of Resubdivision of Lot 37 in the property described aforesaid; and WHEREAS, to permit the CITY OF ELGIN ingress and egress for the purpose of repairing and maintaining said retention basin from time to time, it is necessary to grant to the CITY OF ELGIN a perpetual easement over certain portions of Lots 35 and 36 of the property described aforesaid. NOW, THEREFORE, for and in consideration of the sum of Ten and 00/100 DOLLARS ($10.00), and other good and valuable consideration, paid by Second Party to First Party, the receipt and sufficiency of which being hereby acknowledged, First Party hereby grants to Second Party and its assigns a perpetual easement over Lots 35 and 36 for the purpose of ingress and egress to the aforesaid retention basin as shown on the aforesaid Plat of Resubdivision to permit the Second Party ingress and egress for repair and maintenance of the aforesaid retention basin. Such easement for ingress and egress shall be deemed a general easement across said Lots 35 and 36 until said lots are improved at which time said easement shall be limited to the right to use for ingress and egress only improved roadways and the existing ten (10) foot wide easement running from said retention basin to and under the access ramp of the Northwest Toll Highway and State Route No. 31, 1501360 said ten (10) foot easement having been previously granted and recorded in Document No. 1278513 as recorded in the office of Recorder of Deeds, Kane • County, Illinois.
