RECORD KANE Cfr.r, • lib w„ a . 3%S-1 149491 I E 7SFEB22 AM 115 RESOLUTION WHEREAS, the Board of Education, School District U-46, Kane County, Illinois, is the owner of certain real estate known as the Lincoln School site and described as follows: Lot 1, Block 6 of Sherman's Addition, also Lots 1, 2, 3, 4, 5 and 6 in Block 1 of Elgin National Watch Company's Subdivision, except a dedicated 22 foot alleyway along the Southeast side of Lots 2 and 3 and the Southwest side of Lot 3 in the Southwest 1, Section 13, Elgin, Kane County, Illinois; and, WHEREAS, the Board of Education, School District U-46, Kane County, Illinois, has determined that said site has become unsuitable and unnecessary for school pur- poses, and said site should be sold; and, WHEREAS, the City of Elgin has, by Resolution, declared it is necessary for it to use and occupy said real estate above described; and, WHEREAS, both the City of Elgin and the Board of Education, School District U-46, are municipalities within the meaning and definition of the term "municipality" as defined in An Act in Relation to The Transfer of Interests in Real Estate by The Units of Local Government or School Districts, Chap. 30, P. 156, et seq., of the Illinois Revised Statutes (1977) ; and, WHEREAS, said municipalities have entered into discussions and negotiations in regard to the sale of the above described real estate by Articles of Agreement for Deed for a purchase price of Seventy-Seven Thousand Nine Hundred Seventy-Eight and Ninety-Four One Hundredths ($77,978.94) Dollars, payable upon closing. NOW, THEREFORE, Be it resolved by the Board of Education, School District U-46, Kane County, Illinois, that the real estate described as follows: Lot 1, Block 6 of Sherman's Addition, also Lots 1, 2, 3, 4, 5 and 6 in Block 1 of Elgin National Watch Company's Subdivision, except a dedicated 22 foot alleyway along the Southeast side of Lots 2 and 3 and the Southwest side of Lot 3 in the Southwest 1, Section 13, Elgin, Kane County, Illinois, is unsuitable and unnecessary for school purposes; and, BE IT FURTHER RESOLVED, that said real estate be sold by real estate contract to the City of Elgin in the manner provided by the above described statute of the State of Illinois; and, BE IT FURTHER RESOLVED, that the President and Secretary of the Board of Edu- cation, School District U-46, be and hereby are authorized, empowered, and directed to negotiate, execute, and enter into a certain contract for the sale of real estate be- tween said School District U-46 and the City of Elgin; and, 1494911 - 2 - BE IT FURTHER RESOLVED, that the Kane County Board of School Trustees, Kane County, Illinois, be requested, authorized and directed, as the holder of legal title to the above described real estate, to make, execute and enter into said real estate contract, and to execute a deed on behalf of the Board of Education, School District U-46, to the City of Elgin for said described real estate; and, BE IT FURTHER RESOLVED, that a certified copy of this Resolution be for- warded to the Kane County Board of School Trustees, Kane County, Illinois, and to Mr. James L. Hanson, Superintendent of the Kane County Educational Service Region, with a request that said Kane County Board of School Trustees enter into said con- tract and execute said Deed pursuant to statute in such case made and provided as hereinabove described. The undersigned further certifies that the number of members of said Board of 7 Education is seven, and there were present at said meeting members, and the vote on said Resolution was 7 Ayes and 00 Nays. This vote constitutes more than a two-thirds majority of the members of the Bo d of Education.
