RESOLUTION
ACCEPTING A GRANT OF EASEMENT FROM SCHOOL DISTRICT U-46
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that it hereby accepts the grant of easement for sanitary sewer purposes
made by School District U-46, dated June 17, 1974, a copy of which is
attached hereto and made a part hereof by reference.
BE IT FURTHER RESOLVED that the City Clerk be and is hereby authorized
and directed to cause said grant of easement to be recorded in the Office of
the Recorder of Deeds of Cook County, Illinois.

k EASEMENT
For and in consideration of the sum of One Dollar
($1. 00) , the receipt of which is hereby acknowledged,
and for other good and valuable consideration paid by
the City of Elgin, a municipal corporation of Kane County,
Illinois, (hereinafter sometimes called the "City") to
{ Board of Education, School District U-46, (hereinafter
sometimes called the "Grantor") , the Grantor hereby grants,
assigns and sets over to the City, a perpetual easement in,
over and under the following described property:
A 10 foot wide sanitary easement and a 60 foot wide
temporary construction easement over that part of
the Northeast Quarter of Section 19, Township 41
North, Range 9 East of the Third Principal Meridian,
the center line of which is described as follows :
Commencing at the intersection of the Southerly right
of way line of State Route 19 with a line that is
20. 0 feet Westerly of (measured at right angles
thereto) and parallel with the East line of the Southeast
Quarter of Section 18, Township and Range aforesaid;
thence Southerly, along said parallel line, and being
along a line which is 20. 0 feet Westerly of (measured
at right angles thereto) and parallel with the East
line of the Northwest Quarter of Section 19, Township
and Range aforesaid, a distance of 557. 85 feet to a
point on a line that is 70. 0 feet Northwesterly of
(measured at right angles thereto) and parallel with
the former Southerly line of Memorial Field property;
thence Southwesterly, along said parallel line, a
distance of 377. 40 feet; thence Southeasterly along
a line that forms an angle of 112 degrees 52 minutes
32 seconds to the left with the prolongation of the
last described course, a distance of 10. 85 feet for
the place of beginning of the center line of said
Easements; thence continuing Southeasterly along
said center line, being along an extension of the
last described course, a distance of 218. 82 feet
to the Easterly line of Elgin High School Property
for the terminous of the center line of said Easements.
Being situated in the City of Elgin, Cook County,
Illinois.
to install, maintain, repair and use sanitary sewers,
manholes and appurtenances, subject, however, to the
following terms and conditions :
1. The City will at all times prosecute all work
upon the premises with reasonable care, skill
and diligence and upon completion thereof, will
promptly restore all grounds, roads and sidewalks
to their original condition, except for the
restoration of such trees, shrubs and plants
as may have to be removed in connection with
the installation, maintenance and repair of
the sewer lines, manholes and appurtenances.

2. In addition to said perpetual 10 foot easement
herein conveyed, the Grantor hereby agrees that
the City, in the initial installation of said
sanitary sewers, manholes and appurtenances
and for any maintenance or replacement may move
whatever equipment and machinery that may be
necessary on to the premises of the Grantor during
construction and said equipment and machinery
may rest upon and be operated from land adjacent
to said 10 foot perpetual easement herein granted.
3. Grantor agrees that no buildings will be constructed
over this easement.
A plat of the easement herein granted is affixed hereto
and made a part hereof as Exhibit "A" .

U-46, has caused its name to be signed to these presents by

For and in consideration of the sum of One Dollar

First National Bank of Elgin, a national banking association
as Trustee under Trust Agreement dated February 13, 1973,
and known as Trust Number 2380, (hereinafter sometimes
called the "Grantor") , the Grantor hereby grants, assigns
and sets over to the City, a perpetual easement in, over
and under the following described property:
A 10 foot wide sanitary Easement and a 60 foot wide

On July 18, 1974 I checked with the Cook County Recorder's Office
concerning the recordation of a plat of easement granted to the Elgin
Sanitary District under real estate owned by the City of Elgin in Lord's
Park.
A check of Cook County records by one of their employees revealed
that this plat of easement has not been recorded.
