Trust Number 2596, dated July 11, 1974, of the City of Elgin, County of 73
Kane, State of Illinois, for and in consideration of the sum of Ten Dollars
($10.00) and other good and valuable consideration, receipt of which is
hereby acknowledged, do hereby grant to the City of Elgin, a municipal
corporation of the State of Illinois, in the County of Kane, an easement
for the construction and maintenance of a sanitary sewer in, upon and
over the following described real property in the City of Elgin, County
of Kane and State of Illinois, more particularly described as follows:
A 7.5 foot wide perpetual easement for public utility and
sanitary sewer purposes over the Westerly 7.5 feet (measured at
right angles to the West line thereof) of Lot 10 in First Addition
to Miller-Davis Research and Industrial Center, being a subdivision
of part of the Southeast quarter of Section 32 and part of the
Southwest quarter of Section 33, Township 42 North, Range 8 East
of the Third Principal Meridian according to the plat thereof
recorded in the Recorder's Office of Kane County on October 13,
1971 as Document No. 1206526, being situated in the City of Elgin,
Kane County, Illinois, all as described in the Plat of Easement
attached hereto and made a part hereof by reference.
This Grant of Easement is executed, delivered and is granted upon
the following conditions to-wit:
Grantors, their heirs and assigns, hereby release the City of Elgin,
its agents and employees, assigns and successors from any and all liability for
damage to our remaining lands resulting from this conveyance and construction
and maintenance of said sewer and public utility, provided the Grantee, its
agents and employees, assigns and successors, shall assume as practicable after
construction of said sewer and public utility and all subsequent alterations and
repairs thereto, restore all property for the Grantor to a neat and presentable
condition.
