This agreement made and entered into this t44fb day of
aanve,.t , 1977 , by and between the City of Elgin,
a municipal corporation, hereinafter referred to as City, and
Elgin Granite Works , Elgin, Illinois , hereinafter referred to
as Company.
WITNESSETH
WHEREAS, City desires to have a granite pedestal in-
stalled for the Gifford Bust ; and
WHEREAS, Company has submitted its written proposal
to furnish the necessary labor , materials , equipment and
services ; and
WHEREAS, said proposal is in the City' s best interests .
NOW, THEREFORE, in consideration of the mutual convenants
and promises herein set forth, it is mutually agreed herein by
and between the parties :
1 . Company shall construct and install the pedestal ,
the bust and all the related work in accordance with the City of
Elgin specifications project number 7658 , the terms of which are
incorporated herein by reference and made a part of this agree-
ment.
2. Company shall perform all work in a first class
workmanlike manner and shall correct any defects in said work
for a period of one year commencing with the completion of the
work under this agreement. Upon acceptance of work Company
shall furnish a written guarantee of all labor and materials
for a period of one year.
3 . Company shall indemnify and hold harmless City from
all claims for damages arising out of the performance of this
agreement by Company and shall file certificates of insurance of
personal injury, property damage liability coverage and Workmen' s
Compensation coverage, designating the City of Elgin as additional
insured.

4. Company shall upon oxocution of this agreement
provide a bond acceptable to City in amount of 10-0 percent of
the coitract price established in this agreement. �
5. Company agrees to commence work by VA- \`)-A-1
and shall have all work completed bye„,i- k n11 .
6. City agrees to pay Company the sum of $6 , 593. 00 as
consideration for all work performed by Company under this agree-
ment. Payment shall be made by City no later than 30 days follow-
ing the acceptance of the work by City.
