RESOLUTION NO. 76-35
AUTHORIZING AN AMENDMENT TO THE AGREEMENT FOR IMPROVEMENTS TO THE
INTERSECTION OF BIG TIMBER ROAD AND SLEEPY HOLLOW ROAD IN ELGIN, ILLINOIS
WHEREAS, on May 13, 1975 the City of Elgin and the County of Kane
entered into an agreement for improvements to the intersection of Big
Timber Road and Sleepy Hollow Road; and
WHEREAS, said agreement provided that the agreement and covenants
contained therein would become null and void in the event that a contract
covering the construction work contemplated was not awarded by January 1, 1977;
and
WHEREAS, it does not appear practicable to award such contract until
after the ,expiration date of the agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CHAIRMAN OF THE COUNTY BOARD
be, and is hereby authorized and directed to execute an amendment to the __
agreement between the City of Elgin and the County of Kane, dated May 13, 1975,
for improvements to the intersection of Big Timber Road and Sleepy Hollow.
Road to provide that said agreement shall become null and void in the event :.
that a contract covering the construction work contemplated is not awarded •
by January. 1, 1979.
