This Agreement made and entered into this day of
, 1976 , by and between ARTHUR FUNK and MARGARET
FUNK, his wife, hereinafter called the GRANTORS , and the CITY OF
ELGIN, a municipal corporation, hereinafter called the CITY, Witnesseth:
WHEREAS , the CITY desires to acquire an easement for the
construction of sanitary sewers through the property as hereinafter
described, and
WHEREAS, the GRANTORS are willing to grant said easement
upon certain premises and conditions .
NOW, THEREFORE , in consideration of the mutual promises ,
coenants ,',and conditions contained herein, the parties hereto expressly
,and mutually agree as follows :
1. City assumes obligation for the $1 ,140 . 75 water special
assessment on Lot 6 .
2. City provides one water connection service for your
home , located on Lots 4 and 5.
3. City to have Sanitary District provide one connection
permit for your home, located on Lots 4 and 5.
4. City will assume future maintenance of existing and
proposed sewers .
5. City will restore easement . area.
6 . Grantors will grant to the City an easement, a copy
of which is . attached hereto and made a part hereof and which legally
described said easement.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement as of the day and year first above-written.

EASEMENT
THIS INDENTURE Witnessed, that the grantors , ARTHUR FUNK
and MARGARET FUNK, his wife, Elgin, Illinois , for and in consideration
of One Dollar and No/100 ($1. 00) , and other good and valuable consid-
eratio hereby conveys to the City of Elgin, a municipal corporation

of he County of Kane, State of Illinois , the perpetual right,
privilege and authority to enter upon and occupy for the purpose of
constructing, maintaining, cleaning, repairing, and operating a
sanitary sewer under, across and upon the following described property :
A permanent easement for sanitary sewer purposes , being
20 feet wide (as measured at right angles) over a part
of Lot 6 in Morningside Estates Subdivision, being a
subdivision of part of Section 2 , Township 41 North,
Range 8 East of the Third Principal Meridian, the center
line of said easement being described as follows :
Commencing at the Northwest corner of said Lot 6; thence
Southerly along the Westerly line of said Lot 6 , being
along a curve to the right having a radius of 75 feet,
a distance of 10 feet for the point of beginning of said
easement center line; thence Easterly along a line that .
is parallel and 10. 0 feet Southerly of the Northerly line
of said Lot 6 , to the Westerly line of an existing 10
foot wide public utilities easement, for the terminus
of said easement center line, in the City of Elgin, Kane
County, Illinois .
ALSO a 20. 0 foot wide and temporary construction easement
for sanitary sewer purposes lying Southeasterly of and
adjacent to the aforesaid described permanent easement
in the City of Elgin, Kane County , Illinois.
The right, privilege, and authority is further hereby
given, granted, and conveyed to said City of Elgin, at all times,
to have free access to said sanitary sewer for the purpose of making
any and all connection therewith, together with the right, privilege,
and authority to make any and all repairs which at any time hereafter
become necessary, the same as if said sanitary sewer were constructed
in a public highway. Said grantee shall restore said premises to
its original state.
IN WITNESS WHEREOF, said grantors have signed and sealed
