HomeMy WebLinkAbout74-0703 First Federal Savings Recorded -07o3 Fr rssf- Fed,fal • • • 23 atk EASEMENT 2 031 For and in consideration of the sum of One Dollar ($1. 00) , the receipt of which is hereby acknowledged, and for other good and valuable consideration paid by the City of Elgin, a municipal corporation of Kane County, Illinois, (hereinafter sometimes called the "City") to Federal Savings and Loan Insurance Corporation, (hereinafter sometimes called the "Grantor") , the Grantor hereby grants, assigns and sets over to the City, a perpetual easement in, over and under the following described property: A 10 foot wide sanitary Easement and a 60 foot wide temporary construction Easement over that part of the Northeast Quarter of Section 19 and the Northwest Quarter of Section .20, Township 41 North, Range 9 East of the Third Principal Meridian, the center line of which is described as follows: Commencing at the intersection of the Southerly right of way line of State Route 19 with a line that is 20. 0 feet Westerly of (measured at right angles thereto) and parallel with East line of the Southeast Quarter of Section 18, Township and Range aforesaid; thence Southerly along said parallel line, and being along a line which is 20. 0 feet Westerly of (measured at right angles thereto) and parallel with the East line of the Northeast Quarter of Section 19, Township and Range aforesaid, a distance of 557. 85 feet to a point on a line that is 70. 0 feet Northwesterly of (measured at right angles thereto) and parallel with the former Southerly line of Memorial Field property; thence Southwesterly, along said parallel line, a distance of 377. 40 feet; thence Southeasterly along a line that forms an angle of 112 degrees 52 minutes 32 seconds to the left with the prolongation of the last described course, a distance '' ' of 229. 67 feet to the Easterly line of Elgin High School f property for the place of beginning of the center line �» ' of said Easements; thence Southeasterly along said center line being along an extension of the last described course, a distance of 121. 83 feet; thence Southeasterly along said center line, which forms an angle of 15 degrees 53 minutes 26 seconds to the left with the prolongation of the last described course, a distance of 190. 56 feet; thence Easterly along said center line which forms an angle of 22 degrees 29 minutes 39 seconds to the left with the prolongation of the last described course, a distance of 416. 88 feet for the terminous of the center line of said Easements. Being situated in Hanover Township, Cook County, Illinois. to install, maintain, repair and use sanitary sewers, manholes and appurtenances, subject, however, to the following terms and conditions: 1. The City will at all times prosecute all work upon the premises with reasonable care, skill and diligence and upon completion thereof, will promptly restore all grounds, roads and sidewalks • A• 0 4. to their original condition, except for the restoration of such trees, shrubs and plants as may have to re removed in connection with the installation, maintenance and repair of the sewer lines, manholes and appurtenances. 2. In addition to said perpetual 10 foot easement herein conveyed, the Grantor hereby agrees that the City, in the initial installation of said sanitary sewers, manholes and appurtenances and for any maintenance or replacement may move whatever equipment and machinery that may be necessary on to the premises of the Grantor during construction and said equipment and machinery may rest upon and be operated from land adjacent to said 10 foot perpetual easement herein granted. 3. Grantor agrees that no buildings will be constructed over this easement. A plat of the easement herein granted is affixed hereto and made a part hereof as Exhibit "A" .
