'asements for Water Lines Accepted and Ordered Recorded
g °y Manager presented two executed easements for water lines to serve the
test area: From Sidney O. Burnidge and Alice Burnidge, from Clarence D.

Teresa was present in the interest of the approval of the Final Plat for
$ Lane Subdivision. The Final Plat was recommended for approval by the

WATER LINE EASEMENT
THE GRANTORS, JERRY L. BALER and CECILE L. BALER, his
wife, XIMENNERMINIMNIMME of the City
Ry and the CHICAGO TITLE AND TRUST COMPANY, a corporation
of Illinois, as Trustee tinder Trust No. 36392,
CI of Elgin, County of Kane and State of Illinois,/for and in consideration of
the sum of Ten Dollars ($10. 00) and other good and valuable consideration,
in hand paid, HEREBY GRANT TO THE CITY OF ELGIN, a municipal
corporation, of the State of Illinois, and its successors, a permanent
easement and right-of-way, including the perpetual right to enter upon the
real estate hereinafter described at any time that the said City of Elgin
may see fit or deem necessary and construct, maintain and repair an
underground water line, main, or pipe for the purpose of conveying water
over, across, through and under the lands hereinafter described, together
with the right to excavate and refill ditches and trenches for the location
of said water line, mains, or pipe and the further right to remove trees,
bushes, undergrowth and other obstructions interfering with the location,
construction, and maintenance of said water line, main, or pipe.
The easement and.right-of-way granted herein covers a strip of land
ten feet in width over and across part of the West half of Section 15, Township
41 North, Range 8 East of the Third Principal Meridian in the City of Elgin,
Kane County, Illinois, and is more particularly described as follows:
PARCEL NO. 1.
Beginning at a point on the North and South center line of said
Section 15 that is 689. 50 feet North of the Northerly line of
Larkin Avenue; thence. Westerly, parallel with the East and
West center line of said Section 15, a distance of 660. 0 feet;
thence Westerly along a line which forms an angle of 0
degrees 06 minutes to the right with the prolongation of the
last described course a distance of 647. 49 feet; thence
Northerly along a line which forms an angle of 90 degrees and
28 minutes to the right with the prolongation of the last
described course a distance of 10. 0 feet; thence Easterly
along a line which forms an angle of 89 degrees and 32
minutes to the right with the prolongation of the last described

with the East and West center line of Section 15 as afore-

South lines thereof) of the follow ng described property:

East and West center line of said Section 15 a distance of
660. 0 feet; thence Westerly along a line which forms an
angle of 0 degrees and 06 minutes to the right with the

A plat of said easement prepared by W. A. Rakow & Associates
dated April 26, 1963, is attached hereto and made apart hereof as
it being understood that said plais to be used only for
the purpose of , ide of ing the easement, the Grantors herein
Exhibit "A", ex ressl.y denyingthe accurac of the representation of the
lot sizes indicaed on said plat.
In addition to said perpetual 10 foot easement herein conveyed, the
Grantors hereby agree that the Grantee in the initial installation of said
water line, main, or pipe, may move whatever equipment and machinery
that may be necessary in the construction and installation of said water line,
main, or pipe unto the premises of the Grantors during construction, and
said equipment and machinery may rest upon and be operated from lands
adjacent to said ten foot perpetual easement herein granted.
This easement is granted upon the express condition that said enclosed
water line, main, or pipe be constructed and maintained a sufficient dis-
tance beneath the surface of the above described premises and so constructed
as to permit the Grantors to seed and maintain the surface for lawn or garden
purposes; and to use, maintain and improve the said surface for public or
private street or highway purposes; and upon the express condition that in the
construction and maintenance of said water line, main, or pipe, all damage
to the surface land shall be promptly repaired and replaced in the same
condition as when the Grantee entered upon said premises for such purposes
of construction, repair or maintenance.
