RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 5 WITH CLAUSS BROTHERS
INC. FOR THE JACK COOK PARK FINAL CONSTRUCTION PHASE
(Bid No. 23-037A)
WHEREAS, the City of Elgin has heretofore entered into a contract Clauss Brothers, Inc.
for the Jack Cook Park final construction phase (Bid No. 23-037A); and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 5 attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS,that Richard G. Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 5, a copy of which is attached hereto and made a part hereof by
reference.

PROJECT: Jack Cook Final Phase
CHANGE ORDER No. 5
CONTRACT: Bid 23-037A
SCOPE: To install a solar light fixture for the ROMTEC waterless restroom that was not
identified at the time of bidding.
REASONS FOR CHANGE: The need for a light fixture at the waterless restroom was not an-
ticipated at the time that the project was originally bid. The circumstances said to necessitate this
change in the work were not reasonably foreseeable at the time the contract was signed; the
change is germane to the original contract as signed; and the change order is in the best interests
of the City of Elgin and authorized by law.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: This will be an increase to the
original contract.
ORIGINAL CONTRACT AMOUNT: $4,273,520.00

The original amount of the contract with Clauss Brothers, Inc. is $4,273,520.00. Change Order
No. 5 in the amount of$7,695.00 and previous change orders totaling $111,674.00 will increase
the original contract amount by a total of$l 19,369.00 that sum representing two and eight-tenths
percent (2.8%) of the original contract amount. The new contract amount, inclusive of all change
orders, is$4,392,889.00.
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.
