RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 WITH FIVE STAR ENERGY
SERVICES LLC FOR YEAR 3 LEAD SERVICE LINE REPLACEMENT—CONTRACT B
(Bid No. 24-017)
WHEREAS, the City of Elgin has heretofore entered into a contract Five Star Energy
Services LLC for Year 3 Lead Service Line Replacement—Contract B (Bid No. 24-017); and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 1, a copy of which is attached hereto and made a part hereof by
reference.

CHANGE ORDER No.1
CONTRACT:Year 3 Lead Service Line Replacement--Contract B (Bid No.24-017)
SCOPE: The Year 3 Lead Service Line Replacement Program — Contract B project objective was to
replace approximately 740 lead service lines by March 31, 2025. The total original contract amount was
$7,951,574.00. This change order would allow for approximately sixty (60) additional lead service line
replacements utilizing project savings from another contract.
REASONS FOR CHANGE:
The City's LSLR IEPA loan value for Year 3 construction costs is $9,535,081.00, which includes both
Contracts B and C construction costs.Contract C is nearing completion with an estimated$665,979.36 in
contract value remaining.Due to the savings on Contract C,it is in the best interests of the City to transfer
the estimated remaining contract value from Contract C to Contract B.A final balancing change order will
be completed for both Contract B and Contract C once final construction costs are known.
The circumstances said to necessitate the change in performance were not reasonably foreseeable at the
time the contract was signed; the proposed change is germane to the original contract as signed; and the
change order is in the best interests of the City of Elgin and is authorized by law.
SUMMARY OF CHANGES IN CONTRACT TIME AND WORK:
ORIGINAL CONTRACT AMOUNT: $7,951,574.00
CHANGE ORDER No. I ADD $665,979.36
TOTAL FOR CHANGE ORDER NO. 1: ADD $665,979.36
TOTAL REVISED CONTRACT AMOUNT: $8,617,553.36
The original amount of the contract with Five Star Energy Services LLC is$7,951,574.00. Change Or-
der No. 1 will increase the contract amount by a total of$665,979.36,that sum representing 8.4%of the
original contract amount. The revised contract amount inclusive of all change orders is $8,617,553.36.
OTHER CONTRACT PROVISIONS:All other contract provisions remain the same.
