IN CONNECTION WITH THE USACE FOX RIVER CONNECTIVITY & HABITAT STUDY
CONSULTATION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that pursuant to Elgin Municipal Code Section 5.02.020B(9)the City Council hereby finds that an
exception to the requirements of the procurement ordinance is necessary and in the best interest of
the city; and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Richard G. Kozal, City Manager, and Kimberly A. Dewis, City Clerk, be and are
hereby authorized and directed to execute an Amendment Agreement No. 2 on behalf of the City
of Elgin with Engineering Enterprises, Inc., for supplemental professional services in connection
with the USACE Fox River connectivity & habitat study consultation, a copy of which is attached
hereto and made a part hereof by reference.

Re: Consent Agenda Item 1—Resolution Authorizing Execution of an Amendment Agree-

The city council during its 22 October 2025 committee of the whole meeting unanimously
approved the second amendment to the city's consultation agreement with Engineering En-
terprises, Inc. (EEI) for the U.S. Army Corps of Engineers Fox River Connectivity and Habitat
Study in the amount of$338,028.
The agreement provides supplemental engineering services to predict Fox River water levels
by expanding an existing two-dimensional numerical hydraulic model and constructing a
physical model of the Fox River to simulate the Kimball Street dam removal and the impacts
on the city's Fox River water intake.
A request to expand the scope of the study to analyze the potential impacts on the Fox River
south of the Kimball Street dam, particularly relating to the Grand Victoria Casino riverboat,
was approved by the city council.
The current southern boundary under the scope of the study is the Highland Avenue bridge.
To simulate the effects from the dam removal in the area of the Grand Victoria Casino, the
University of Illinois (EEI's subcontractor) is recommending that the two-dimensional model
be extended to U.S. Route 20. The university is also recommending that the 1D HEC-RAS
model be extended down to the South Elgin dam to provide updated boundary conditions at
U.S. Route 20. (1D HEC-RAS refers to the one-dimensional hydraulic modeling capabilities
within the U.S. Army Corps of Engineers' Hydrologic Engineering Center River Analysis Sys-
tem (HEC-RAS) software.) The university will also investigate the potential implications of
the removal of the South Elgin dam on the boundary conditions and adjust them accordingly.
The revised fee for amendment two with this expanded scope of services is now$363,577.The

project's revised completion date is now 14 February 2027. The USACE's tentative schedule
indicates the city will need to commit to the project by January 2027.The University of Illinois
and EEI team are aware of this deadline and expect to have finalized results in November or
December 2026,with the remaining time spent fine tuning and completing the documentation
necessary for the study.

AMENDMENT AGREEMENT NO. 2
THIS AMENDMENT AGREEMENT No. 2 is hereby made and entered into this
19th day of November , , 2025, by and between the City of Elgin, Illinois, a municipal
corporation (hereinafter referred to as the "CITY"), and Engineering Enterprises, Inc., an Illinois
corporation (hereinafter referred to as "ENGINEER"). The University of Illinois Department of
Civil and Environmental Engineering, a body corporate and politic of the State of Illinois, through
the University of Illinois Urbana-Champaign, Sponsored Programs Administration, 1901 South
First Street, Suite A, Champaign IL 61820-7406 (hereinafter referred to as"University")will be a
subconsultant to EEI for this project.
WHEREAS, the CITY and ENGINEER hereto have previously entered into an agreement
dated August 10, 2022 (hereinafter referred to as "Original Agreement") and approved by City
Council on August 10, 2022, wherein the CITY engaged the ENGINEER to furnish certain
professional services in connection with the USACE FOX RIVER CONNECTIVITY &
HABITAT STUDY CONSULTATION (hereinafter referred to as the"Project"); and
WHEREAS,the CITY and ENGINEER hereto have previously agreed to amend the original
agreement dated June 26, 2024 (hereinafter referred to as "Amendment Agreement No. 1"),
providing for certain amendments to the Original Agreement relating to additional services to be
performed for the Project; and
WHEREAS, the parties hereto have determined it to be in their best interest to amend the
Original Agreement, as amended by Amendment Agreement No.1; and
WHEREAS, the CITY has determined that the proposed scope of the Project should be
modified to include Supplemental Professional Engineering Services for the NUMERICAL
MODEL EXTENSION AND PHYSICAL MODELING STUDY OF KIMBALL STREET DAM
REMOVAL AND IMPACTS ON THE CITY OF ELGIN WATER INTAKES (hereinafter
referred to as the"Supplemental Services")as set forth in Attachment A-2, B-2, C-2 and D-2 and
incorporated by reference herein;and
WHEREAS, the parties have determined and agree that the total fees to be paid to the
Engineer pursuant to the Original Agreement shall be in a total amount not to exceed Thirty-four
Thousand Four Hundred and Sixty-nine dollars($34,469.00); and
WHEREAS, the parties have determined and agree that the total fees to be paid to the
Engineer pursuant to Amendment Agreement No. 1 shall be in a total amount not to exceed One
Hundred Nineteen Thousand and Eighteen dollars($119,018.00);and
WHEREAS,the parties hereto have determined and agree that the total maximum payment
for the Supplemental Services described in this Amendment Agreement No. 2 shall be in the
amount of Three Hundred Sixty-three Thousand Five Hundred and Seventy-seven dollars
($363,577.00),and
WHEREAS,the parties hereto have determined and agree that the total fees to be paid to the
Engineer pursuant to the Original Agreement,Amendment No. 1 and Amendment Agreement No.
2 now total an amount not to exceed Five Hundred Seventeen Thousand and Sixty-four dollars
($517,064.00);and
WHEREAS,the changes contemplated by this Amendment Agreement No. 2 are germane

to the Original Agreement as signed;and this Amendment Agreement No. 2 is in the best interests
of CITY and is authorized by law.
NOW, THEREFORE, for and in consideration of the mutual promises and covenants
provided for herein,and other good and valuable consideration,the sufficiency of which is hereby
acknowledged,the parties hereto agree as follows:
1. The above recitals are incorporated into and made a part of this Agreement as if fully
recited hereby.
2 That Section 1 of the Original Agreement is hereby amended by adding the following
subparagraph E thereto to read as follows:
"E. The ENGINEER shall also provide Supplemental Services for the Project which
includes the Professional Engineering for the NUMERICAL MODEL EXTENSION AND
PHYSICAL MODELING STUDY OF KIMBALL STREET DAM REMOVAL AND
IMPACTS ON THE CITY OF ELGIN WATER INTAKES in accordance with Exhibit A-
2."
3. That Section 2 of the Original Agreement is hereby amended by adding the following to
the end of Subparagraph B:
"B. ENGINEER shall provide the Supplemental Services provided for in Amendment
Agreement No. 2 in accordance with the schedule outlined herein and detailed in Exhibit
B-2."
4. That Section 4 of the Original Agreement is hereby amended by adding the following
paragraph G,paragraph H and Payment Schedule to read as follows:
"G. For services described in Exhibits A-2, B-2 and C-2, ENGINEER shall be paid on a
time and materials basis in accordance with the rates described on Exhibit C-2 & D-2 for
a not to exceed amount of Three Hundred Sixty Three Thousand Five Hundred and
Seventy-seven dollars ($363,577.00) for the services to be provided pursuant to this
Amendment Agreement No. 2, unless substantial modifications and scope of work are
authorized in writing by the CITY and approved pursuant to a further written amendment
to this Agreement. The total fees to be paid to the ENGINEER pursuant to the Original
Agreement,Amendment No. 1 and Amendment Agreement No. 2 now total Five Hundred
Seventeen Thousand and Sixty-four dollars ($517,064.00). The detailed basis of the
additional fee associated with Amendment Agreement No. 2 is included in Exhibit C-2.
"H. The CITY shall make periodic payments to the ENGINEER for services described
in Exhibits A-2, B-2 and C-2 based upon actual progress within 30 days after receipt and
approval of invoice. Said periodic payments to the ENGINEER shall not exceed the
amount shown in the following schedule,and full payments for each task shall not be made
until the task is completed and accepted by the DIRECTOR."

5. That except as amended in this Amendment Agreement No. 2, the Original Agreement as
previously amended by Amendment Agreement No. I shall remain in full force and
effect.
6. That in the event of any conflict between the terms of this Amendment Agreement No. 2
and the terms of the Original Agreement and Amendment No. I, the provisions of this
Amendment Agreement No. 2 shall control.
7. This Amendment Agreement may be executed in counterparts, each of which shall be an
original and all of which shall constitute one and the same agreement. For the purposes of
executing this Amendment Agreement. any signed copy of this Amendment Agreement
transmitted by fax machine or e-mail shall be treated in all manners and respects as an
original document. The signature of any party on a copy of this Amendment Agreement
transmitted by fax machine or e-mail shall be considered for these purposes as an original
signature and shall have the same legal effect as an original signature. Any such faxed or
e-mailed copy of this Amendment Agreement shall be considered to have the same binding
legal effect as an original document. At the request of either party any fax or e-mail copy
of this Amendment Agreement shall be re-executed by the parties in an original form. No
party to this Amendment Agreement shall raise the use of fax machine or e-mail as a
defense to this Amendment Agreement and shall forever waive such defense.

SCOPE OF SERVICES
USACE FOX RIVER CONNECTIVITY & HABITAT STUDY CONSULTATION -
AMENDMENT NO. 2

BACKGROUND
This Scope of Services is supplemental to the Scope of Services identified in the original USACE
Fox River Connectivity & Habitat Study Consultation Agreement, as well as the Scope of Services
identified in Amendment No. 1 to the original agreement. The Amendment No. 1 scope of services
included a Two-Dimensional Diagnostic Study of Kimball Street Dam Removal and Impacts on
the City of Elgin Water Intakes. The University of Illinois developed the two-dimensional
numerical model. After developing the numerical model in accordance with the original scope, it
was determined that the model needs to be expanded in order to better replicate the Fox River
sediment transport characteristics in the stream reach that could impact the long-term hydraulics
of the Fox River in the vicinity of the City's intake. In addition, the City has requested the model
extend further downstream in order to assess sediment transport to at least the National Street
bridge. Therefore. part of the scope of this amendment will be to extend the numerical model.
Once the numerical model is complete, the University of Illinois will develop a physical model of
the Fox River in the vicinity of the City's intake in order to further study the sediment transport and
hydraulic characteristics of the river near the intake and the potential impacts if the Kimball Street
dam is removed. The University of Illinois will also model potential modifications within the river
that could mitigate the hydraulic effects of the Kimball Street dam removal.
In addition to the proposed numerical and physical modeling by the University of Illinois, the
project team will conduct a computational fluid dynamics analysis of the Fox River intake to better
define the minimum Fox River water level at which the intake will be operable. The defined
elevation will be utilized within the numerical and physical modeling efforts as a future constraint
if the Kimball Street Dam is removed.
The project team will develop a conceptual cost estimate for proposed instream improvements as
defined within the U of I modeling efforts. The project team will also develop a conceptual cost
estimate to replace the seawall along the south bank of the Fox River. In addition. the project
team will develop conceptual cost estimates for reinstalling water main and sanitary sewer Fox
River utility crossings that may be impacted with the dam removal.
The tasks and subtasks for EEI's proposed scope of work for this amendment are as follows:

The University of Illinois Department of Civil and Environmental Engineering will be a
subconsultant to EEI for this work. The University of Illinois' proposed scope and budget
justification are included as Attachments A and B, respectively.
EXCLUSIONS
Due to the University's status as a public land-grant non-profit institution of higher education, there
are certain Prime agreement terms which shall not apply to University, as follows: Articles 3, 9,
10, 12, 22, and any warranties or audit costs prescribed by Article 29. Further, "Legal Resident,"
as discussed in Article 29 shall be defined as: any individual lawfully residing within the United
States. University shall be liable to the City of Elgin for the damages or claims caused by
University or its representatives' negligent acts or omissions in the performance of this
Agreement.
ADDITIONAL SERVICES
The above scope summarizes the work items that will be completed for this amendment.
Additional work items, including additional meetings beyond the meetings defined in the above
scope, shall be considered outside the scope of the agreement and will be billed in accordance
with EEI's current Standard Schedule of Charges. No such additional services shall be performed
unless authorized pursuant to a written amendment to this Agreement entered into and executed
by the parties.

Background
At recommendation of the U.S. Army Corps of Engineers, the City of Elgin, IL is considering removal
of the Kimball Street Dam on the Fox River to help restore ecosystem connectivity and improve water
quality in the Fox River system. Removal of the Kimball Street Dam has potential ramifications for a
drinking water intake located on the west bank of the river approximately 0.9 miles(1.5 km)upstream
of the existing dam.
Previous work performed by the University of Illinois has indicated that there is a likelihood that the
bathymetric feature known as the"saddle"will remain after removal of the dam and act as a control,
maintaining water level at the intake. However, the uncertainty associated with this result is still
relatively large due to a lack of measurements quantifying sediment transport rates in the Fox. As
such, the relative factor of safety is low as projections indicate that the water intake could be dry
under low-flow conditions for the worst-case scenario.
Scope of Work
The currently proposed scope of work extends the 2D numerical model that was developed for the
previous study four miles upstream to the now-removed Carpentersville dam.Additionally,the reach
will be extended downstream to the U.S. 20 bridge. This study will incorporate bathymetric
information provided by the U.S.Army Corps of Engineers and consists of datasets collected in 2015
and 2023.The purpose of this extended model is two-fold.
1. To allow more distance for"self-adjustment"of the sediment transportation boundary
condition to ensure that the sediment load within the reach of interest(from the City of
Elgin's water intake to the Kimball Street dam) more accurately represents the actual
sediment load.
2. Examine the fate of sediment scoured from the Kimball Street Dam pool and determine the
impact on the river adjacent to downtown Elgin (generally from Highland Ave to the north
and National Steet to the south)
3. Provide additional information to inform selection of the upstream boundary location for a
physical model study.
To aid in the development of appropriate boundary conditions at the downstream boundary of the 2D
numerical model,we propose extending the existing HEC-RAS model of the reach down to the South
Elgin Dam. This model will be used to examine the potential impact of removal of the South Elgin
Dam on water-surface elevations within the City of Elgin river reach and ensure that appropriate
boundary conditions are applied
We additionally propose construction of a physical model of the reach of the Fox River in the vicinity
of the City of Elgin's water intake.The exact extents of the model are unknown at this time and will be
determined based on the additional results provided by the above-described numerical model study.
The physical model will be used to assess conditions in the immediate vicinity of the water intake
including the efficacy of training structures designed to minimize sedimentation in front of the intake.
A series of flow control structures designed to maintain the water-surface elevation at the water
intake during periods of low flow under worst-case erosion conditions were proposed in the initial
study;the effectiveness of these structures will also be tested in the physical model.
Approach
The proposed numerical model study will be developed using Telemac-2D with the GAIA sediment
transport and bed-evolution module and will build upon previously completed work performed by
the University of Illinois. Telemac-2D and GAIA are part of the Telemac-Mascaret modeling suite
(https://opentelemac.org) a suite of inter-operable 1D, 2D, and 3D numerical modeling code
developed by Electricite de France and used in a wide range of free-surface flow applications
involving riverine, estuary, and coastal environments. Telemac-2D is the two-dimensional modeling
component and solves the shallow-water free-surface flow equations on a structured (triangular)
mesh. The GAIA sediment transport and bed-evolution module is capable of modeling mixtures of
multiple sediment size classes, non-cohesive and cohesive sediments (or mixtures of the two) and
can model suspended and/or bed-load transport.
The numerical model will build upon the existing model developed by the University of Illinois and
will extend it approximately four miles upstream to the location of the now-removed Carpentersville
dam. This model will incorporate approximately 70 cross-sections collected in 2015 and 2023 to
build the in-channel bathymetry and lidar data to construct emergent/overbank portions of the
channel(Figure 1 —left).The model will also incorporate newly collected (July 2025)depth-of-refusal
measurements collected on the Fox River by the Illinois Department of Natural Resources (IDNR).
These measurements consist of 19 cross-river transects with a minimum of 4-probe locations in
each transect (Figure 1 —right). The measurements quantify the depth to top-of-sediment, depth to
top-of sand, depth to top-of-gravel, and depth of refusal at each location. This data will be used to
refine the spatial variability of the sediment within the numerical model and allow a more accurate
accounting of sediment layering and consolidation.
The FEMA effective model for the reach, adapted into a HEC-RAS by model by Burns & McDonnell
and Stantec, has been used to-date to calibrate and validate the Telemac2D model. For the present
effort, this model will be extended downstream to the South Elgin Dam utilizing cross-section
information from the US Army Corps of Engineers and the Illinois Department of Natural Resources
(IDNR).This model will be used to set appropriate boundary conditions at the downstream boundary
of the Telemac2D model.As part of this effort,the impact of potential removal of the South Elgin Dam
on water-surface elevations in the study reach will be examined.
A movable bed physical model study will be constructed to examine the effectiveness of dikes along
the south-east bank of the river near the Elgin Water Department's Slade Avenue facility in minimizing
or eliminating deposition in front of the existing intake structure. Additionally,the use of submerged
flow-training dikes/vanes within the"narrows"will be examined for their effectiveness at maintaining
water-levels at the intake during periods of low flow.
The exact extent of the model is unknown and will be determined based on an analysis of results from
the extended numerical model. Criteria from determining the model extents include: ensuring that
the upstream boundary of the physical model is sufficiently upstream to allow accurate reproduction
of flow patterns at the training structures/intake; making sure that the distribution of transported
sediment is similar to that observed in the numerical model; and ensuring that results at the
downstream end of the model are not adversely affected by the proximity of physical model
boundary.A preliminary assessment of likely model extents is show in Figure 2.
The physical model will be built using Froude similarity, indicating that the Froude number(the ratio
between inertia and gravitational forces) is the same in the model and real(prototype) systems.The
model will be built with a distorted scale of 1/175:1/10 (H:V); scale is preliminary pending final
determination of the model extents. The distorted scale means that the vertical direction is
exaggerated by a factor of 17.5 — this is done to ensure that depths in the model are sufficient to
acquire accurate measurements in the model and head losses are representative of turbulent flow
conditions.

From the above equations, it can be seen that the flow scales with the vertical length scale to the 3/2
power multiplied by the horizontal length scale — therefore for a horizontal scale of 1/175 and a
vertical scale of 1/10,the discharge ratio is approximately 1/5534.The velocity ratio is 1/3.16.
Sediment is scaled using a different relationship. Due to the change in sediment particle behavior as
particles get finer (i.e., inter-particle forces due to electrical charges become important) it is often
not possible to geometrically scale sediment particles since they will not behave as granular
material.Therefore,it is often necessary to use larger particles than indicated from a direct geometric
scaling; this can be achieved by using a different relationship that balances the erosional and
depositional potential of the sediment by scaling the ratio of the fall velocity to the shear velocity(a
characterization of bed friction) so that the ratio is equal between the modeled and prototype
systems.This ratio can be expressed as:

By reducing the density of the particles between prototype and modeled systems, it is possible to
utilize larger particles and still achieve representative results if the condition shown above is
satisfied.The plan is to use crushed walnut shells as model material,since we have had good results
in previous physical model studies(Tanana River Bridge Scour, Hanson Engineering, 2015).

Data Requirements
Data required to perform this study include expected flow rates in the Fox River at the upstream
extent of the modeled reach,estimated inflows from in-reach tributaries(Tyler Creek,Jelkes Creek,
and Carpenter Creek; Poplar Creek for extended HEC-RAS model), sediment grain-size and depth-
of-refusal data,water-surface elevations at the downstream model extent,and in-channel
bathymetry for the Fox River.
The preponderance of data required to perform this study is available from public and/or online
data sources including the USGS NWIS web-platform(flow rates and estimated suspended
sediment load)and online reports(grain-size)or has already been collected as part of the previous
study. Data/reports developed by the City of Elgin's consultants have either been supplied or will be
requested as necessary.
Deliverables
Deliverables for this project will include a technical memo detailing the findings of the extended
numerical model and the physical modeling effort including data, assumptions, and results.
Numerical modeling results files will be provided. Measurement data including any photos or videos
collected during the physical modeling effort will also be provided. Additional figures/presentation
aids will be provided on request to assist City of Elgin Staff and their consultants in presenting the
modeling results in meetings or public forums. Quarterly progress updates in the form of in-person
or online meetings with the aid of PowerPoint slides will be provided.

University of Illinois at Urbana-Champaign
The University's budget year is based on our academic year and runs from 08/16—08/15
A. SENIOR/KEY PERSONNEL:
Dr. Marcelo H. Garcia will serve as the principal investigator and commit .5 summer months of effort
($17,154)to this project to perform project oversight, model results review, and co-author the
technical memo/report and exhibits. Senior Personnel salaries increase 3.5% annually.
B. OTHER PERSONNEL:
Research Engineer: One research engineer will commit 2.0 months of effort($17,064) to perform
model development oversight, supervise construction of the physical model, and assist in authoring
project status reports and the technical memo and generating exhibits. Salary increases 3.5%
annually.
Graduate Research Assistants (GRAs):. One student will be hired as a Post-BS student (at a rate
of$2696/month) for a period of 12 months. An additional student will be hired Post-Prelim
($3082/month) for a period of 15 months. Student(s)will perform the numerical and physical modeling
effort as described in the Scope of Work. analyze modeling and experimental results. and co-author
the technical memo/report and exhibits. The GRA salaries increase 3.5% annually.
Undergraduate Hourly: One undergraduate hourly employee will be hired (at a rate of S15/hr)to
assist with the physical model study. This student will be involved in data collection and analysis of
the physical model results.
C. Fringe Benefits:
Senior personnel and academic professional fringe benefits for senior personnel are estimated at
45.10% of salary. Graduate Research Assistants fringe benefit rates estimated at 9.72% of stipend.
Undergraduate students fringe benefit rates estimated at 7.66% of stipend.
D. CAPITAL EQUIPMENT: (>$5,000 cost per item, can use fabricated instrument approach)
The large computational domain and long modeling times required by the numerical model study
necessitates the purchase of a dedicated high-performance computer to ensure that the study can be
completed within the 15-month project timeline. A total of$12,000 is requested for purchase of this
computer.
E. TRAVEL:
None
G. OTHER DIRECT COSTS:
A total of$25,000 is requested in materials and supplies for construction of the physical model These
costs include materials to construct the model reach, water-supply piping. any required
instrumentation mounts/carriages and sediment for movable-bed modeling. Machine shop services in
the amount of$30,000 (-430 hours at$70/hr) are requested for construction of the physical model.
A total of$585 has been requested for registration for the Illinois Association for Floodplain and
Stormwater Management conference to present the results of the present work.
GRA Tuition/Remission for graduate research assistants is calculated at a rate of 64%of the student
stipend.
