HomeMy WebLinkAbout25-104 Resolution No. 25-104 RESOLUTION ACCEPTING A GRANT FROM THE TOWN OF ELGIN AND AUTHORIZING EXECUTION OF A SERVICE AGREEMENT WITH THE TOWN OF ELGIN TO PROVIDE SOCIAL AND RECREATION SERVICES FOR YOUTH RELATED PROGRAMS TO RESIDENTS OF ELGIN TOWNSHIP BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the City of Elgin hereby accepts the Town of Elgin's grant in the amount of$16,212 to provide social and recreation services for youth related programs to residents of Elgin Township. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Richard G. Kozal, City Manager, and Kimberly A. Dewis, City Clerk, be and are hereby authorized and directed to execute a Service Agreement on behalf of the City of Elgin with the Town of Elgin,to provide social and recreation services for youth related programs to residents of Elgin Township, in such form as approved by the Corporation Counsel. s/David J. Kaptain, Mayor Presented: May 28, 2025 Adopted: May 28, 2025 Omnibus Vote: Yeas: 8 Nays: 0 Attest: s/Kimberly Dewis Kimberly Dewis, City Clerk SERVICE AGREEMENT AGREEMENT, made this 7th day of April,2025, by and between the TOWN OF ELGIN("Township"),and Elgin Police Department("Recipient"). WHEREAS,TOWNSHIP is authorized to make expenditure of funds to provide social services for the poor and/or aged of Elgin Township, 60 ILCS 1/85-13(a)(1) (G); and WHEREAS, Recipient has made application for receipt of such funds,for the following specific purpose: To support social service programs of the Recipient to Elgin Township residents; and WHEREAS,the Elgin Board of Trustees,on the 7th day of April,2025, by formal motion and vote of said Board,did approve the application of Recipient in the amount of Sixteen Thousand Two Hundred Twelve Dollars($ 16,212.00). NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL PROMISES SET FORTH HEREIN, AND OTHER GOOD AND VALUABLE CONSIDERATION,IT IS AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS: 1. Recipient agrees that all portions of these monies shall be used,directly or indirectly, to provide social services for youth programs for residents of Elgin Township. 2. Recipient agrees that if more than twenty-five percent(25%) of any construction project is funded by any portion of the funds received under this Agreement,that all laborers and mechanics employed by contractors or subcontractors will be paid wages not less than those specified by the Secretary of Labor under the Davis-Bacon Act for similar construction in the locality in effect at time of project. 3. Recipient agrees that no person shall on the grounds of race,color,creed, national origin or sex,be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity funded with any portion of the funds received under this Agreement. 4. Disbursement of funds shall be subject to the following further terms and conditions: a. The total of Sixteen Thousand Two Hundred Twelve Dollars($ 16,212.00) shall cover the period commencing on the 1st day of June, 2025 through the 31 s`day of August, 2025 ("the Funding period"). b. The funds shall be disbursed according to the following schedule: One-time disbursement of funds in full. Agreement Page 2 of 2 c. Recipient agrees to follow proper accounting and auditing procedures; to maintain a record of all monies received from the Elgin Town Board of Trustees, and of the disbursement of said monies; and to submit to the Town Board of Trustees a final report at the end of the Funding Period. Please include the total number of children from Elgin Township served and how the monies were spent. Recipient shall expend all funds within the Funding Period. Any funds not spent on this specific program are to be returned to Elgin Township. d. Recipient agrees to utilize the monies hereunder in strict adherence to the terms and conditions of this Agreement. 5. Recipient makes the following representations and warranties, as a condition of receipt of funds under this Agreement: a. Recipient is authorized to receive such funds, and the persons executing this Agreement have been authorized to do so,all by formal resolution of the Board of Directors or other governing body of Recipient. 6. Other conditions: Use of the Elgin Township logo is allowed and recommended for purposes of marketing your selected program.
