FOR THE SUMMIT STREET AND DUNDEE AVENUE INTERSECTION IMPROVEMENTS (Bid No. 23-004) WHEREAS, the City of Elgin has heretofore entered into a contract Plote Construction, Inc. for the Summit Street and Dundee Avenue intersection improvements (Bid No. 23-004); and WHEREAS,it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 1 attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that Richard G. Kaptain, Mayor Presented: April 10, 2024 Adopted: April 10, 2024 Omnibus Vote: Yeas: 9 Nays: 0 Attest: s/Kimberly Dewis Kimberly Dewis, City Clerk ,( OFf<C • ' City of Elgin Change Order ELGIN, ILLINOIS PROJECT No. 340114 CHANGE ORDER No. 1 CONTRACT: Summit Street and Dundee Avenue Intersection Improvements(Bid No. 23-004) SCOPE: This change order will amend the agreement to provide a revised completion date for the above stated contract. The project had an original completion date of October 31, 2023,plus 10 working days. The proposed contract time extension will suspend construction work until no later than May 1, 2024, and establish a revised final project completion date of September 6,2024. Construction work for the subject project began on April 17, 2023, and was stopped on May 4, 2023, due to the proposed construction's conflict with existing gas utilities. Construction work was resumed on July 13, 2023, following the resolution of utility conflicts. Construction work proceeded until No- vember 22, 2023,when work was suspended due to cold weather and the winter season. Conditions of Change Order No. I are: • Construction work will resume no later than May 1,2024. • Substantial completion of construction work by August 21,2024,which includes the striping and opening of the roadway throughout the project area. • Final completion of construction work on September 6, 2024, which will include the installation and activation of permanent traffic signals throughout the project. • That as except amended in this Change Order No. I the Original Agreement shall remain in full force and effect. REASONS FOR CHANGE: Prior to beginning Stage l of construction work, the contractor began per- forming exploratory digging throughout the project area, starting on April 17, 2023. The contractor not- ed several areas in which the project's proposed construction work conflicted with existing gas utilities. These conflicts were not foreseen in the design phase of the project and were not noted or included on the project plans. The contractor's explorations found an existing gas utility on the west side of Dundee Avenue that ran from Summit Street northward that was a significant source of conflict, as it disrupted proposed storm sewer and roadway widening work. The contractor was unable to begin Stage 1 construction work until the gas utility company provided a design and schedule for the relocation of the existing gas utility in conflict. The contractor stopped Stage 1 construction work on May 4, 2023, and resumed on July 13, 2023, following coordination between the contractor and the gas utility company, and the resolution of utility conflicts. During and prior to the period of stopped work, city staff, the city's consulting engineer, and the contractor attempted to coordinate with the gas utility company to determine a resolution of the utility conflicts, and throughout did not receive timely responses from the gas utility company. The con- tractor was unable to complete work during this period that lasted more than two months, and both city staff and the consulting engineer recommend the extension of contract time and a revision to the project completion date. The circumstances said to necessitate the change in performance were not reasonably foreseeable at the time the contract was signed. The change is germane to the original contract as signed. The change order is in the best interests of the City of Elgin and authorized by law. SUMMARY OF CHANGES IN CONTRACT AMOUNT: This contract is not being amended as to cost. Change Order No. 1 and previous change orders totaling $0 will increase the original contract amount by a total of$0, that sum representing zero percent(0%)of the original contract amount. The new contract amount, inclusive of all change orders is$4,732,543.80. OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.
