RESOLUTION
AUTHORIZING EXECUTION OF AN AMENDMENT AGREEMENT WITH THE
SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 73 MUNICIPAL DIVISION,
ELGIN PUBLIC WORKS CHAPTER
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that Richard G. Kozal, City Manager, and Kimberly A. Dewis, City Clerk, be and are hereby
authorized and directed to execute an Amendment Agreement on behalf of the City of Elgin with
Service Employees International Union Local 73 Municipal Division Elgin Public Works Chapter,
a copy of which is attached hereto and made a part hereof by reference.

AMENDMENT AGREEMENT
This Amendment Agreement is made and entered into as of the 10th day of January, 2024,
by and between the City of Elgin(hereinafter called the"City")and the Service Employees Service
International Union,Local 73 Municipal Division,Elgin Public Works Chapter(hereinafter called
the"Union").
WHEREAS, the City and Union have entered into an Amended Collective Bargaining
Agreement for the period of January 1, 2022 through December 31, 2024 (such Amended
Collective Bargaining Agreement is hereinafter referred to as the("Subject Collective Bargaining
Agreement");and
WHEREAS,the City has requested and the Union has agreed to amend the provisions of
Article IX, Section 7 of the Subject Collective Bargaining Agreement regarding qualifications for
a Water Operator II Class A Certification.
NOW, THEREFORE, for and in consideration of the mutual undertakings herein, the
mutual undertakings set forth in the Subject Collective Bargaining Agreement,and other good and
valuable consideration,the receipt and sufficiency of which is hereby acknowledged,the City and
the Union hereby agrees as follows:
1. Article IX Wages, Section 7 Water Operator II Class A Certification, of the Subject
Collective Bargaining Agreement be and is hereby amended to read as follows:
"Section 7. Water Operator II Class A Certification. Certification as a Public Water
Supply Operator, or Operator in Training, of any Class, issued by the Illinois
Environmental Protection Agency (IEPA) shall be required for appointment to the
position of a Water Operator II. Persons appointed to the Water Operator II position
shall thereafter be required to obtain a certification as a Class A Public Water Supply
Operator in Training issued by the IEPA within one year of date of appointment. The
City reserves the right to extend the certification deadline by six month intervals at the
City's discretion. Persons appointed to the Water Operator II position shall thereafter
be required to obtain a Class A certification as a Class A Public Water Supply Operator
as soon as such person has obtained the requisite experience to apply for such
certification. Maintenance of a Class A certification is required and shall constitute an
essential requirement necessary to perform the essential job functions of a Water
Operator II position."
2. That except as specifically amended herein, the Subject Collective Bargaining
Agreement shall remain in full force and effect.
IN WITNESS WHEREOF, the Parties have entered into and executed this Amendment
Agreement as of the date first written above.
