RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 WITH RAY'S ELECTRICAL
SERVICE LLC AND TOM'S PLUMBING INC. FOR THE YEAR 2 LEAD SERVICE LINE
REPLACEMENT PROGRAM—CONTRACT D
(BID NO. 23-014)
WHEREAS, the City of Elgin has heretofore entered into a contract with Ray's Electrical
Service LLC and Tom's Plumbing Inc. for the Year 2 Lead Service Line Replacement Program —
Contract D (Bid No. 23-014); and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 1, a copy of which is attached hereto and made a part hereof by
reference.

CONTRACT: Year 2 Lead Service Line Replacement Program- Contract D (Emergency Repairs) (Bid
No. 23-014)
SCOPE: The Year 2 Lead Service Line Replacement Program - Contract D project objective was to
replace lead service lines on an as-needed basis when a leak was identified by the City on a lead water
service line. The scope of work called for the awarded contractor(joint venture between Ray's Electrical
Service and Tom's Plumbing) to respond to a lead service line in need of replacement within 20 days of
receiving notice from the City. The project included replacing water service lines on public and private
property (with a signed Temporary Construction Easement agreement from the homeowner). The total
original contract amount is $884,973.00.
REASONS FOR CHANGE:
The Year 2 Emergency Repairs - Contract D states the work involves the replacement of up to 60 lead
service lines, and that the contract will remain in force for 365 calendar days (May 2, 2024) or until 60
lead service lines are replaced, whichever comes first. As of February 12, 2024, Ray's and Tom's have
replaced 45 lead service lines and will continue to replace up to 60 services or until May 2, 2024. To
ensure that the City has a lead service line emergency repair contractor in place until the Year 3
emergency repair contract can be approved, it is in the best interest of the City to modify the existing
contract such that the contractors will continue to replace lead service date through the completion date
of 365 calendar days (May 2, 2024), regardless of the number of service lines that have been replaced,
up to the contract amount.
The circumstances said to necessitate the change in performance were not reasonably foreseeable at the
time the contract was signed; the change is germane to the original contract as signed; and the change
order is in the best interests of the City of Elgin and is authorized by law.

The original completion date of the contract with Ray's Electrical and Tom's and Tom's Plumbing is
May 2, 2024, or until 60 lead service lines are replaced, whichever comes first. Change Order No. 1 will
remove the maximum number of services to be replaced and keep the completion date of 365 calendar
days(May 2, 2024), up to the contract amount.
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.
