RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 4 WITH CLAUSS BROTHERS
INC. FOR THE JACK COOK PARK FINAL CONSTRUCTION PHASE
(Bid No. 23-037A)
WHEREAS, the City of Elgin has heretofore entered into a contract Clauss Brothers, Inc.
for the Jack Cook Park final construction phase(Bid No. 23-037A); and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 4 attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS,that Richard G. Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 4, a copy of which is attached hereto and made a part hereof by
reference.

PROJECT:Jack Cook Final Phase
CHANGE ORDER No.4
CONTRACT: Bid 23-037A
SCOPE: To provide playground construction extras related to the installation of the clubhouse feature as
well as construction extras related to the installation of the ROMTEC waterless restroom that were not
identified at the time of bidding
REASONS FOR CHANGE: The reasons supporting the change order must demonstrate the change or-
der is:
• The circumstances said to necessitate the change in performance were not reasonably foreseeable
at the time the contract was signed
• The change is germane to the original contract as signed
• The change order is in the best interests of the City of Elgin and authorized by law
SUMMARY OF CHANGES IN CONTRACT AMOUNT: This will be an increase to the original con-
tract.
ORIGINAL CONTRACT AMOUNT: $4,273,520.00

Of the clubhouse feature $49,409.00
TOTAL FOR CHANGE ORDER NO. 4 ADD $49,409.00

Change Order No. 3 $43,800.00
TOTAL OF PREVIOUS CHANGE ORDERS: ADD $62,265.00
TOTAL REVISED CONTRACT AMOUNT: $4,385,194
The original amount of the contract with Clauss Brothers Inc. is$4,273,520.00 Change Order No. 4 and
previous change orders totaling $62,265.00 will increase the original contract amount by a total of
$111,674.00 that sum representing two point six percent(2.6%)of the original contract amount.The new
contract amount, inclusive of all change orders is $4,385,194.00
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.
