RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 2 WITH JOEL KENNEDY
CONSTRUCTION CORP FOR THE YEAR 2 LEAD SERVICE LINE REPLACEMENT
PROGRAM—CONTRACT A
(BID NO. 23-001)
WHEREAS, the City of Elgin has heretofore entered into a contract with Joel Kennedy
Construction Corp for the Year 2 Lead Service Line Replacement Program—Contract A(Bid No.
23-001); and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 2 attached hereto; and
WHEREAS,that pursuant to Elgin Municipal Code Section 5.02.020B(9)the City Council
hereby finds that an exception to the requirements of the procurement ordinance is necessary and
in the best interest of the city.
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 2, a copy of which is attached hereto and made a part hereof by
reference.

CHANGE ORDER No.2
CONTRACT: Year 2 Lead Service Line Replacement—Contract A(Bid No. 23-001)
SCOPE: The Year 2 Lead Service Line Replacement Program — Contract A project objective was to
replace approximately 324 lead service lines in 2023. The total original contract amount was
$6,452,155.00.
REASONS FOR CHANGE:
The original scope of the Year 2 Lead Service Line Replacement Program —Contract A was completed
by the substantial completion date of December 1, 2023. The original final completion date was May
31', 2024. In 2024, the City received additional funding through the Illinois Department of Commerce
and Economic Opportunity (DCEO) for the removal of lead service lines. The funds must be spent by
June 30, 2024: therefore, it was decided to extend the existing Year 2 Lead Service Line Replacement
Program—Contract A to expedite the replacement of additional lead service lines. An additional 74 lead
service line replacements have been added to Contract A for an approximate additional value of
$925,000. The addresses include commercial properties along Dundee Avenue and high-risk facilities
such as daycares and parks. The completion date will also need to be extended to June 30,2024.
The circumstances said to necessitate the change in performance were not reasonably foreseeable at the
time the contract was signed; the change is germane to the original contract as signed; and the change
order is in the best interests of the City of Elgin and is authorized by law.

The original amount of the contract with Joel Kennedy Construction Corp is $6,452,155.00. Change Or-
der No. 1 decreased the contract amount by a total of$2,102,581.40, that sum representing 33% of the
original contract amount. Change Order No. 2 will increase the contract amount by a total of
$925,000.00, that sum representing 14% of the original contract amount. The revised contract amount,
inclusive of all change orders is $5,274,573.60.
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.
