RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 WITH IHC CONSTRUCTION
COMPANIES, LLC FOR THE LEAD SERVICE LINE REPLACEMENT PROGRAM—
CONTRACT C
(BID NO. 23-013)
WHEREAS,the City of Elgin has heretofore entered into a contract with IHC Construction
Companies,LLC for the Lead Service Line Replacement Program—Contract C(Bid No. 23-013);
and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 attached hereto; and
WHEREAS,that pursuant to Elgin Municipal Code Section 5.02.020B(9)the City Council
hereby finds that an exception to the requirements of the procurement ordinance is necessary and
in the best interest of the city.
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Richard G. Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 1, a copy of which is attached hereto and made a part hereof by
reference.

CHANGE ORDER No. 1
CONTRACT: Year 2 Lead Service Line Replacement Program—Contract C (Bid No.23-013)
SCOPE: The Year 2 Lead Service Line Replacement Program—Contract C engaged INC Construction
Companies to replace approximately 88 lead service lines in 2023. The total original contract amount
was $1,463,116.
REASONS FOR CHANGE:
The original scope of the Year 2 Lead Service Line Replacement Program—Contract C was completed
by the substantial completion date of December 1, 2023. The original final completion date was May
31", 2024. In 2024,the City received additional funding through the Illinois Department of Commerce
and Economic Opportunity(DCEO) for the removal of lead service lines. These funds must be spent by
June 30, 2024; therefore, it was decided to extend the existing Year 2 Lead Service Line Replacement
Program—Contract C to expedite the replacement of additional lead service lines using the funds re-
ceived from DCEO.
An additional 76 residential lead service line replacements have been added to Contract C for an approx-
imate additional value of$809,000. The original contract value has approximately$159,000 funds allo-
cated but unspent; therefore,an additional $650,000 is required for this change order. The completion
date will also need to be extended to June 30, 2024.
The circumstances said to necessitate the change in performance were not reasonably foreseeable at the
time the contract was signed; the change is germane to the original contract as signed; and the change
order is in the best interests of the City of Elgin and is authorized by law.

The original amount of the contract with IHC Construction Companies is $1,463,116.00. Change Order
No. 1 will increase the original contract amount by a total of$650,000.00,that sum representing 44%of
the original contract amount. The new contract amount, inclusive of all change orders is$2,113,116.00.
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.
