RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 WITH DN TANKS, LLC FOR
THE BAFFLE WALL REPLACEMENT PROJECT
(BID NO. 23-046)
WHEREAS, the City of Elgin has heretofore entered into a contract with DN Tanks, LLC
for the baffle wall replacement project(Bid No. 23-046); and
WHEREAS, it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 attached hereto; and
WHEREAS,that pursuant to Elgin Municipal Code Section 5.02.020B(9)the City Council
hereby finds that an exception to the requirements of the procurement ordinance is necessary and
in the best interest of the city.
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 1, a copy of which is attached hereto and made a part hereof by
reference.

CHANGE ORDER No. 1
CONTRACT: Elgin, IL Baffle Wall Replacement Bid No.23-046
SCOPE: The original Project Scope for the 1MG Riverside Steel GSR was to blast and paint the entire
roof structure and panels in preparation for replacement of all the baffle walls and associated support
and fastening components. This Change Order is for all activities associated with the additional work of
replacing the entire deteriorated rafter support structure. This Change Order also provides for the
blasting and painting of the remainder of the reservoir interior (shell and floor) to provide complete
replacement of the interior wet coating system.
REASONS FOR CHANGE: Upon starting the Project on the scheduled date of October 16, 2023, the
Contractor expressed concern regarding some observed roof rafters that were corroded to the extent they
had partially broken free from their attachment points. After scaffolding had been erected, KLM
performed a closer inspection of the roof structure and concluded many rafters were either corroded
beyond repair or of questionable integrity. The conditions of the rafter structure were not foreseeable at
the time the Project Specifications were developed due to the emergency nature of the baffle wall
replacement and the inability to take the reservoir out of service. Given the extent of the degradation,
the recommendation by KLM is to replace the entire roof rafter system with new steel of matching size
and quantity.
With removal and replacement of the entire roof support structure, it is anticipated that significant
damage will be done to the existing coatings within the reservoir. Replacement of the entire interior
roof and roof structure coatings is already part of the original Project Scope; however, replacement of
the shell and floor coatings is not. By replacing the shell and floor coatings, the reservoir interior will
have a uniform coating system that will ideally provide 15 to 20 years of service without needing
significant repairs or disturbance to the new baffle walls. The result would be complete replacement of
all interior wet coatings.
The circumstances said to necessitate the change in performance were not reasonably foreseeable at the
time the contract was signed; the change is germane to the original contract as signed; and the change
order is in the best interests of the City of Elgin and is authorized by law.

TOTAL REVISED CONTRACT AMOUNT: $1,973,850.40
The original amount of the contract with DN Tanks of Illinois, Inc. is$1,497,800.00. Change Order No.
1 will increase the original contract amount by a total of $476,050.40, that sum representing
approximately thirty-one and eight-tenths percent (31.8%) of the original contract amount. The new
contract amount, inclusive of all change orders is$1,973,850.40.
OTHER CONTRACT PROVISIONS: The original contract included a substantial completion date of
December 7, 2023. Due to the unforeseen circumstances encountered during construction and the
necessity to perform the work in specified seasons the new substantial completion date is December 15,
2024.
