RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 WITH SCHAEFGES
BROTHERS, INC. FOR THE FESTIVAL PARK SPLASHPAD REHABILITATION
(Bid No. 23-038)
WHEREAS, the City of Elgin has heretofore entered into a contract Schaefges Brothers,
Inc. for the Festival Park splashpad rehabilitation(Bid No. 23-038); and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 1, a copy of which is attached hereto and made a part hereof by
reference.

CHANGE ORDER No. 1
CONTRACT: Festival Park Splashpad Rehabilitation (Bid No. 23-038)
SCOPE: The change order adds $18.303 to the Festival Park Splashpad Rehabilitation contract
to allow for necessary sealing of the surge pit due to a condition which was unforeseen at the
time of the initial contract approval.
REASONS FOR CHANGE:
• At the time the contract signed, leakage from the area surrounding the surge pit was a
condition which was not known to any party. It is necessary to repair this condition in or-
der to prevent sludge leakage into the surge pit and to provide the best possible product.
• The circumstances said to necessitate the change in contract amount were not reasonably
foreseeable at the time the contract was signed.
• The change is germane to the original contract as signed.
• The change order is in the best interests of the City of Elgin and is authorized by law.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The contract is being increased by
$18,303. This will allow the contractor to seal the surge pit preventing infiltration of sludge
from the surrounding area.

TOTAL REVISED CONTRACT AMOUNT: $942,730
The original amount of the contract with Schaefges Brothers, Inc. is$924,427. Change Order
No. I will increase the original contract amount by a total of$18,303,that sum representing 2
percent (2%)of the original contract amount. The new contract amount, inclusive of all change
orders is$942,730.
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.
