HomeMy WebLinkAbout24-113 Unsigned by IDOT Resolution No. 24-113 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE STATE OF ILLINOIS ACTING BY AND THROUGH ITS DEPARTMENT OF TRANSPORTATION FOR CERTAIN IMPROVEMENTS IN CONNECTION WITH THE U.S. ROUTE 20 AND REINKING ROAD ROUNDABOUT PROJECT BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that David J. Kaptain, Mayor, and Kimberly A. Dewis, City Clerk, be and are hereby authorized and directed to execute an Agreement on behalf of the City of Elgin with the State of Illinois acting by and through its Department of Transportation,for certain improvements in connection with the US Route 20 and Reinking Road roundabout project,a copy of which is attached hereto and made a part hereof by reference. s/David J. WITNESSETH: WHEREAS, the STATE, in order to facilitate the free flow of traffic and ensure safety to the motoring public, is desirous of improving approximately 1,178 lineal feet of FAP Route 345, US 20 at Reinking Road, identified as STATE Job No.: C-91-242-22, Contract Number 61J28, STATE Section No. 19-00187-00-CH, as follows: The general scope of the work consists of the reconstruction of the existing US 20 and Reinking Road intersection into a roundabout. Other work includes new sidewalk, new multi-use path, new lighting, new landscaping elements, proposed watermain replacement, and all other work necessary to complete the improvement in accordance with the approved plans and specifications; and WHEREAS, the STATE has approved the design of the intersection improvement project with the condition that the proposed roundabout must include roadway lighting, and WHEREAS, the CITY has complied with the STATE's requirements to include roadway lighting at the proposed roundabout, and WHEREAS, the CITY has requested that the roundabout include landscaping elements to improve roadway aesthetics, and WHEREAS, the CITY is desirous of said improvement in that same will be of immediate benefit to the CITY residents and permanent in nature. NOW, THEREFORE, in consideration of the mutual covenants contained herein,the parties hereto agree as follows: 1. Upon final field inspection of the improvement and so long as US 20 is used as a STATE Highway, the STATE agrees to maintain or cause to be maintained the traffic lanes and pavement markings, the curb and gutter, stabilized shoulders, ditches adjacent to those traffic lanes, and the storm sewers and appurtenances by performing those functions necessary to keep the sewer in a serviceable condition including cleaning sewer lines, inlets, manholes, and catch basins along with the repair or replacement of inlet, manhole and catch basins'frames, grates or lids. 2. Upon final field inspection of the improvement, the CITY agrees to maintain or cause to be maintained those portions of the improvement which are not maintained by the STATE, including new and existing sidewalks, CITY owned utilities including appurtenances thereto and highway lighting, including furnishing the electrical energy thereof, and landscaping elements within the roundabout center island and splitter islands. The cost proration for this improvement is as shown on Exhibit A attached hereto and made a part hereof. 3. The CITY has passed a resolution authorizing an agreement with the State regarding cost appropriation and maintenance responsibilities for this improvement, a copy of which is attached hereto as Exhibit B and made a part hereof. 4. It is mutually agreed that the actual lighting system maintenance will be performed by the STATE either with its own forces or through an ongoing contractual agreement. 5. All costs associated with the installation, future maintenance, or replacement of non-standard Department equipment, finish or hardware shall be the sole responsibility of the applicant. This includes, but is not limited to, painting of the lighting hardware, aesthetic poles, etc.The applicant shall be required to use the Department's electrical maintenance contractor to perform maintenance functions or apply for a highway permit to do this work. 6. The STATE's Electrical Maintenance Contractor shall maintain the Lighting System Equipment located at the US 20 and Reinking Road Roundabout and shall invoice the CITY for the costs related to said maintenance. 7. It is mutually agreed, if, in the future, the STATE adopts a roadway or lighting improvement passing through the lighting system included herein which requires modernization or reconstruction to said lighting system then the CITY agrees to be financially responsible for its share of the lighting system and will be responsible for all costs to relocate or reconstruct the lighting system equipment in conjunction with the STATE's proposed improvement. 8. Under penalties of perjury, the CITY certifies that its correct Federal Tax Identification number is 36-6005862 and it is doing business as a GOVERNMENTAL ENTITY, whose mailing address is: City of Elgin 150 Dexter Court Elgin, IL 60120 Obligations of the STATE and the CITY will cease immediately without penalty or further payment being required if, in any fiscal year, the Illinois General Assembly or Federal funding source fails to appropriate or otherwise make available funds for this contract. This AGREEMENT and the covenants contained herein shall be null and void in the event the contract covering the construction work contemplated herein is not awarded within the three years subsequent to execution of the agreement.
