The Illinois Department of Military Affairs (DMAIL) and CITY OF ELGIN (Licensee) enter
into the following agreement pursuant to Use and Rental of Armories (20 ILCS
1805/65.):
1 . Licensee will be permitted to use the following areas located at the ELGIN
READINESS CENTER on the dates and times indicated:
a. Licensed Areas (Premises): Drill Floor
b. Dates/Times of Use: May 7, 2024 (3:00-9:30pm)
c. Authorized Uses of Premises: Mayor's Award Ceremony
2. Licensee certifies that any activity conducted will be done under the supervision
of competent instructors, and that proper safety precautions will be strictly adhered to at
all times. Licensee further certifies that the licensed areas will be used solely for the
purposes authorized herein, and all participants will be restricted to the authorized
premises.
3. Licensee will thoroughly clean all licensed areas after use. properly dispose of all
waste, and leave the premises in the same condition as when occupied by Licensee. In
this regard. Licensee will clean the premises using its own personnel, hire a licensed
janitorial/cleaning service, or directly hire N/A National Guard volunteers to clean the
premises at a rate of N/A per hour for each person hired. The Licensee's cleaning plan
will be delivered to DMAIL, with names of contractors if applicable, not later than three
(3) business days prior to the event.
4. This Agreement may be terminated by either party by giving three (3) days prior
written notice to the other party. Notwithstanding the foregoing provision, DMAIL has
the right to terminate this Agreement without prior notice, and Licensee will promptly
relinquish the licensed areas upon request of DMAIL, if said premises are required for
DMAIL military instruction or use to respond to urgent military necessity.
5. Licensee will comply with all applicable DMAIL regulations and safety rules listed
in the rental worksheet when using the premises, and DMAIL reserves the right to
immediately terminate this agreement or order the removal of any person for any
violation of proper safety practices or other improper conduct, as determined by
authorized DMAIL personnel.
6. Permission to use the above licensed area is given as an accommodation to
Licensee, and rent charged for the use of the premises identified above in the amount of
$146.90 (6.5 hours (o? $22.60/hour) will be paid by Licensee to the "Department of
Military Affairs Trust Fund". Send to Illinois Department of Military Affairs, ATTN:
Facility Usage — Melissa Eskew, 1301 N. MacArthur Blvd., Springfield. IL 62702. The
fees must be delivered to DMAIL not later than the beginning of the event.
7. Licensee hereby covenants and agrees that it will comply with all Federal. State
and local statutes, ordinances, and regulations, and further covenants that:
a. No gambling will be permitted on the premises.
b. No smoking will be permitted inside any building.
c. The Licensee will not engage in the sale of any merchandise or service
without the prior written approval of the Adjutant General.
d. The Licensee will not discriminate against any person or group due to
race, color. gender, national origin, religion, or handicap.
e. The Licensee will make no alterations, additions, or improvements. either
temporary or permanent, in or about the premises without the prior written approval of
the Adjutant General.
f. The Licensee shall not sublet the premises nor assign this License, in
whole or in part.
g. No alcoholic beverages will be possessed, dispensed, consumed, sold on
or delivered to the premises.
8. Licensee will exercise its privileges hereunder at its own risk. All injuries to
Licensee's personnel, or damage to Licensee's property. incurred while utilizing the
premises or while on DMAIL property are the responsibility of the Licensee, and DMAIL
will assume no liability therefore. The Licensee will also be liable for damage to DMAIL
property or equipment regardless of whether such damage was caused by the
Licensee's agents or servants or participants. DMAIL shall have the right, but shall not
be obliged, to repair such damage, and the Licensee shall be responsible for the costs
thereof, which shall be paid by the Licensee within thirty (30) business days after receipt
of written notice of such costs and associated estimates or receipts from qualified and
reputable sources.
9. The Licensee hereby covenants and agrees to provide a certificate showing
Liability/Property Loss/Property Damage insurance, in amounts satisfactory to DMAIL
and with the Illinois Department of Military Affairs named as an additional insured, to
cover claims for personal injury, including death, sustained by any person, and for
damage to or loss of personal property or government property. arising out of or in
connection with the Licensee's use of the premises. The certificate of insurance will
be provided to DMAIL not later than seven (7) business days prior to the event,
except that agencies of the State of Illinois are self-insured and are not required
to provide such evidence.
10. Licensee will hire one(1) National Guard volunteer(s) to provide security for
National Guard equipment and facilities during Licensee's use. Such personnel will be
hired directly by Licensee at a rate of $17.50 per hour for each person hired. Such
personnel will be accountable to the facility manager and will provide security for the
premises as noted above; such personnel will not be engaged in maintaining order or
crowd control at the event, and they will not be used to provide security for Licensee's
equipment or property. The names of security personnel hired by Licensee will be
delivered to DMAIL not later than three (3) business days prior to the event.
11 . The City of Elgin shall save and hold harmless the Illinois Department of Military
Affairs, its directors, officers, employees, and volunteers from any and all liability, claim,
and demands whatsoever kind or nature to the extent arising out of the negligent acts or
omissions of the City of Elgin, its agents, employees, or guests.
The City of Elgin will defend itself from any such claims without expense and will pay
any damages based thereon and shall pay costs, excluding attorneys' fees, and other
expenses arising therefrom, excluding only those acts which result from the sole or
contributory negligence of the Illinois Department of Military Affairs as Owner.

executed by their proper officers and officials.
