RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. I WITH BOLDER
CONTRACTORS, INC. FOR THE BLUFF CITY BOULEVARD COMBINED SEWER
SEPARATION PROJECT—PHASE III
(BID NO. 22-026)
WHEREAS, the City of Elgin has heretofore entered into a contract with the Bolder
Contractors, Inc. for the Bluff City Boulevard combined sewer separation project—Phase III (Bid
No. 22-026); and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 1, a copy of which is attached hereto and made a part hereof by
reference.

CHANGE ORDER No. I
CONTRACT: Bid No.22-026- Bluff City Boulevard Combined Sewer Separation Project—Phase III
SCOPE:
The Bluff City Boulevard Combined Sewer Separation Project Phase III project objective was to separate
the existing combined sewer into two separate systems for storm water collection and sanitary sewer col-
lection. The scope of work called for installation of storm Reinforced Concrete Pipe (RCP) of various
sizes between 12-inch to 42-inch diameter. Structures such as catch basins, storm manholes, sanitary
sewer work and water main work were included in the scope of work. The entire scope of work occurred
within a residential neighborhood. A significant amount of the underground utilities are located within
permanent pavement areas therefore requiring the disposal of the existing excavated material and replace-
ment with aggregate trench backfill. This change order addresses the additional time for the procurement
of aggregate trench backfi11.
REASONS FOR CHANGE:
The Notice to Proceed (NTP) for this project was issued to Bolder Contractors, Inc. on June 11, 2022.
From June 71h, 2022 to July 26`h, 2022 the International Union of Operating Engineers Local 150 were
striking against Lehigh Hanson, Vulcan Materials, and Lafarge Holcim. Lehigh Hanson, Vulcan Materi-
als,and Lafarge Holcim are all aggregate material suppliers for the Chicagoland area.Bolder Contractors,
Inc. source of aggregate material for the project was from Lafarge Holcim. This strike significantly re-
duced the availability of aggregate material needed for trench backfill therefore delaying the start of con-
struction for the project. This delayed start of construction pushed the completion date into the winter
months when weather dependent restoration activities cannot be completed, such as Hot-Mix Asphalt
(HMA) resurfacing and landscaping. Due to this Bolder Contractors, Inc. is requesting an extension of
time to the original contract completion date of November 22"d,2022 to May 15d',2023. Bolder Contrac-
tors, Inc.will not receive additional compensation for any compensable delays associated to the aggregate
strike.
The circumstances said to necessitate the change in performance time were not reasonably foreseeable at
the time the contract was signed;the change is germane to the original contract as signed; and the change
order is in the best interests of the City of Elgin and is authorized by law
SUMMARY OF CHANGES IN CONTRACT TIME:
The additional time is for the delayed construction start due to International Union of Operating Engineers
Local 150 strike.

The original completion date of the contract with Bolder Contractors is November 22nd, 2022. Change
Order No. 1 totaling an additional 174 Calendar Days will increase the original contract completion date
to May 15a',2023.
