RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 AND FINAL WITH
MAINTENANCE COATINGS COMPANY FOR 2023 PAVEMENT MARKING PROGRAM
(Bid No. 23-023)
WHEREAS, the City of Elgin has heretofore entered into a contract with Maintenance
Coatings Company for 2023 Pavement Marking Project(Bid No. 23-023); and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 and Final attached hereto.
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 1 and Final, a copy of which is attached hereto and made a part
hereof by reference.

CHANGE ORDER No.1 AND FINAL
CONTRACT: 2023 Pavement Marking Program(Bid No.23-023)
SCOPE: This change order will adjust quantities of pavement marking totals in 2023 towards the com-
pletion of the 2023 Pavement Marking Program scope.A contract to perform annual pavement markings
was awarded to Maintenance Coatings Company on April 26th,2023. in the amount of$363,815.Addi-
tional work, specifically towards a pilot program to enhance bike lane markings along Edison Ave. and
Wing Park Blvd., was quoted at$42,000.Approval of this change order will add material quantities to-
wards work germane to the original contract award and project specifications.
REASONS FOR CHANGE:
• The details of the pilot program for the additional pavement markings necessitating this change
order were not reasonably foreseeable at the time contract was signed.
• The change is germane to the original contract as signed.
• The change order is in the best interests of the City of Elgin and authorized by law.

SUMMARY OF CHANGES IN CONTRACT AMOUNT:
The cost of the contract is being amended to reflect the needed materials towards completion of the pro-
ject which are more fully described in Exhibit A,attached hereto and made a part hereof.
ORIGINAL CONTRACT AMOUNT: $363,815

The original amount of the contract with Maintenance Coatings Company is $363,815. Change Order
No. 1 will increase the original contract amount by a total of$42,000, that sum representing an eleven
and one-half percent(116%)increase of the original contract amount. The new contract amount,inclu-
sive of all change orders,is$405,815.
OTHER CONTRACT PROVISIONS:All other contract provisions remain the same.
