RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 2 WITH
ELECTRICAL RESOURCE MANAGEMENT (ERM) FOR PHASE II LED
STREET LIGHT CONVERSION PROJECT
(Bid No. 22-057)
WHEREAS, the City of Elgin has heretofore entered into a contract with Electrical
Resource Management (ERM) for Phase II LED Street Light Conversion project (Bid No. 22-
057); and
WHEREAS, it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 2 attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that Richard G. Kozal, City Manager, be and is hereby authorized and directed
to execute Change Order No. 2, a copy of which is attached hereto and made a part hereof by
reference.

CONTRACT: Phase II LED Street Light Conversion Project. (Bid No. 22-057)
Change Order
SCOPE: This change order will allow further adjustments to materials (LED light fixtures) required to-
wards the completion of the phase II LED street light conversion project which were not known at the
time of award. A contract to secure 2,617 LED retrofit light fixtures built to specification to be placed
into existing luminaire housings was awarded to Electrical Recourse Management on December 7th
2022. Change Order No. 1 has previously been approved and related to one hundred and ninety three
(193) luminare housings that had been identified at that time as unsuitable to accept retrofit fixtures.
Since Change Order No. 1, an additional eight hundred and nineteen (819) luminaire mounting configu-
rations have been identified as unsuitable to accept the retrofit fixtures. Approval of this change order
will allow for the further adjustment in materials towards work germane to the original contract award
and project specifications.
REASONS FOR CHANGE:
• The infrastructure conditions necessitating this change order were not reasonably foreseeable at
the time the contract was signed.
• The change is germane to the original contract as signed.
• The change order is in the best interest of the City of Elgin and authorized by law
SUMMARY OF CHANGES IN CONTRACT AMOUNT:
The cost of the contract is being amended to reflect the material adjustment necessary towards complet-
ing the project, which are more fully described in Exhibit A attached hereto and made a part hereof.

The original amount of the contract with Electrical Resource Management is $1,436,500. Change Order
No. 2 totaling $69,615 and previous Change Order No. 1 totaling $58,497 will increase the original con-
tract amount by a total of $128,112 that sum representing 8.9 percent increase of the original contract
amount. The new contract amount, inclusive of all change orders is $1,564,612.
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.
